Article 2 of the Convention. Weekly rest day. In its previous comment, the Committee requested the Government to explain to what extent the weekly rest day is set to be the same for all workers and also to coincide with the day already established by tradition or custom in the country. Noting that section 16 of the Labour Act 1992 merely provides for the basic entitlement to one day off for every week, the Committee recalls that the Convention is articulated around three principles: regularity (24 hours rest in every period of seven days), continuity (a period of rest comprising at least 24 consecutive hours) and uniformity (the day of rest should in principle be the same for everyone). The Committee accordingly requests the Government to provide additional information as to how these principles of the Convention are implemented in law and practice.
Article 5. Compensatory rest. Further to its previous comment, the Committee notes the Government’s indication that the new draft legislation is being prepared to replace the Labour Act, and that section 43 of the draft provides for compensatory leave for an employee who works on the day of weekly rest. The Committee requests the Government to keep the Office informed of any progress made in the process of adoption of the new labour legislation and to transmit a copy once it has been adopted.
