The Committee takes note of the Government’s first report.
Article 2(3) of the Convention. Consideration of the ratification of relevant occupational safety and health (OSH) Conventions of the ILO. The Committee notes the Government’s indication concerning the submission to Parliament of all the ILO instruments that may be subject to ratification, as well as the submission for consultation of OSH-related statutes to the Steering Committee on Conditions of Work (COCT), where the social partners are represented at the national level. The Committee requests the Government to provide further information on the manner in which consideration is given to the measures which could be taken to ratify relevant ILO Conventions, on the periodicity of the consultations with the social partners in the COCT and on the outcome of these consultations.
Article 3(1). Implementation of the national policy on OSH. The Committee notes the information provided by the Government concerning its national policy on OSH, and particularly in relation to the 2016–20 Occupational Health Plan, the role of the social partners and the review of the previous plan during its formulation, as well as the annual reviews of the implementation of the plan, which contain national loss and occupational health indicators. The Committee requests the Government to provide further details on the modalities for the practical implementation of the national policy and on the role of the social partners in this process.
Article 4(2)(d). Arrangements to promote, at the level of the undertaking, cooperation as an essential element of workplace-related prevention measures. The Committee notes the information provided by the Government on the promotion of cooperation between management, workers and their representatives within committees on health, safety and conditions of work (CHSCT). The Committee notes that, as part of the reform of the Labour Code and in accordance with section 2 of Act No. 2017-1340 of 15 September 2017 enabling the adoption, by Ordinance, of measures to strengthen social dialogue, the bodies representing workers, including the CHSCT, were merged into a single body, forming economic and social committees whose responsibilities differ according to the size of the undertaking. The Committee requests the Government to provide further information on the effects that the attribution of former responsibilities of the CHSCT to new economic and social committees have had on the practical application of OSH-related cooperation in undertakings.
Article 4(3)(h). Support mechanisms for a progressive improvement of occupational safety and health conditions in microenterprises, in small and medium-sized enterprises and in the informal economy. The Committee takes note of the initiatives aimed at small and medium-sized enterprises, including in the framework of the 2016–20 Occupational Health Plan, and of the funds allocated to improving conditions of work. The Committee requests the Government to continue to provide information on the results of the support provided to small and medium-sized enterprises and to very small enterprises in the framework of the 2016–20 Occupational Health Plan, and on the support mechanisms available to the informal economy.
Article 5(1). Monitoring and evaluation of the national programme on OSH in consultation with the most representative organizations of employers and workers. The Committee notes the information provided on the formulation, implementation and monitoring of the 2016–20 Occupational Health Plan. The Committee requests the Government to provide information on the evaluation carried out of the 2016–20 Occupational Health Plan in consultation with the social partners, and on how this evaluation contributes to the formulation of subsequent plans.
Article 5(2)(d). Objectives, targets and indicators enabling the evaluation and periodic review of the national programme on OSH. The Committee notes the procedure for the annual review of the occupational health plan, which includes updating an OSH scoreboard that is compiled with the social partners and consists of national loss and occupational health indicators. The Committee requests the Government to provide a copy of the scoreboards, indicators and annual reviews of the results achieved by the occupational health plan.
