Direct Request (CEACR) - adopted 2015, published 105th ILC session (2016)

The Committee notes the observations of the National Confederation of Workers of Burkina (CNTB), received on 25 August 2015, and the Government’s report and response to the CNTB’s observations.
Articles 2, 3 and 5 of the Convention. Implementation of a national policy on vocational rehabilitation and employment of persons with disabilities. Consultations. The Government refers, in its report, to the progress in implementing the national strategy for the protection and promotion of persons with disabilities. The Government also refers to the mandate and the composition of the Multi-Sectoral National Council for the Protection and Promotion of the Rights of Persons with Disabilities in Burkina Faso (COMUD/Handicap) and to the actions taken by its secretariat. The CNTB indicates that efforts are being made in the public service and mentions, by way of example, that posts were automatically assigned to applicants with a disability during the 2015 recruitment session. The CNTB notes that persons with disabilities are mostly engaged in craft trades. Furthermore, in response to the request made by the Committee to indicate the measures adopted with a view to providing employment opportunities for persons with disabilities on the open labour market, the Government refers to the effective recruitment of 97 persons with disabilities in the public service in 2014; the opening of special counters for the reception of applications from persons wishing to apply for the public service competitive examination; and the funding of individual economic projects for 1,200 persons through direct state subsidies in 2013. The Committee requests the Government to continue to provide information on the impact of measures adopted with a view to providing employment opportunities for persons with disabilities on the open labour market. Noting that Burkinabé employers and organizations of persons with disabilities are represented on the COMUD/Handicap, the Committee requests the Government to specify how the workers’ organizations are consulted in practice, particularly in the framework of the COMUD/Handicap, on issues covered by the Convention. The Committee also requests the Government to continue to provide information on the activities of the COMUD/Handicap.
Article 4. Equality of opportunity and treatment between men and women workers with disabilities and other workers. The Government refers to strategic line II of the national strategy for the protection and promotion of persons with disabilities, which recommends improving access for persons with disabilities to the microfinance and credit scheme. The Government also indicates that the effective application of a 10 per cent quota in the private sector is under review. The Committee requests the Government to provide information on the implementation of the measures provided for in the national legislation to guarantee equality of opportunity and treatment between men and women workers with disabilities and other workers.
Article 7. Evaluation and adaptation of vocational rehabilitation and employment services for persons with disabilities. The Government indicates that persons with disabilities benefit from support and care from basic social services. Furthermore, the regional vocational training centres set up by the State ensure that vocational training leading to qualifications is provided for young persons, including young persons with disabilities. The Committee requests the Government to indicate the measures taken to ensure that the existing guidance, vocational training, placement, employment and other related services enable persons with disabilities to secure, retain and advance in employment.
Article 8. Rural areas and remote communities. The Government indicates that decentralized services of the ministerial departments responsible for social action, national education, health, vocational training and employment are established in all provinces in Burkina Faso. Furthermore, within the framework of the implementation of the national strategy for the protection and promotion of persons with disabilities, the Government has undertaken to develop guidelines, standards and intervention protocols in this area. The Committee requests the Government to provide information on the impact of the measures taken or envisaged to ensure the establishment of vocational rehabilitation and employment services for persons with disabilities living in rural areas and remote communities.
Article 9. Availability of qualified staff for persons with disabilities. The Government indicates that the supervision and support activities carried out by specialized education professionals are backed up by technical monitors trained in social maladjustment and disability. The trained technical monitors provide vocational training for groups targeted by specialized education in the various support structures. The Committee requests the Government to continue to provide information on the results achieved by the availability of qualified staff for the vocational rehabilitation of persons with disabilities.
Parts IV and V of the report form. The Committee requests the Government to provide statistics on the employment of persons with disabilities, disaggregated, where possible, by age, sex and type of disability; and extracts of reports, studies or surveys on issues covered by the Convention.

Articles 2, 3 and 5 of the Convention. Implementation of a national policy on vocational rehabilitation and employment of persons with disabilities. The Committee notes the Government’s report received in August 2012, which contains information on the matters raised in its 2007 direct request. The Committee notes with interest the adoption of Act No. 012-2010/AN to protect and promote the rights of persons with disabilities and Decree No. 2009-530/PRES/PM/MTSS/MASSN/MS establishing the conditions of employment and training for persons with disabilities, of 30 April 2010 and 17 July 2009, respectively. In this regard, the Government indicates that the adoption of these texts has led to the implementation of a national strategy for the protection and promotion of persons with disabilities, accompanied by a three-year plan of action, adopted by the Council of Ministers in July 2012. Furthermore, at the same time, three decrees were also adopted respecting the conditions for issuing the disability card for persons with disabilities in Burkina Faso, the adoption of social health and education measures for persons with disabilities and the adoption of social measures for persons with disabilities in relation to employment, vocational training and transport. The Government adds that the Multi-Sectoral Committee for the Rehabilitation and Equality of Opportunity of Persons with Disabilities (COMUREC/Handicap) did not achieve the objectives assigned to it. In this respect, the Committee notes with interest the adoption of Decree No. 2012-406/PRES/PM/MASSN/MEF/MS establishing and determining the responsibilities, composition and functioning of the Multi-Sectoral National Council for the Protection and Promotion of the Rights of Persons with Disabilities in Burkina Faso (COMUD/Handicap), dated 15 May 2012. The Committee understands that the Council recently held its first ordinary sitting. The Committee invites the Government to provide information in its next report on the progress achieved in relation to the Convention through the implementation of the national strategy for the protection and promotion of persons with disabilities. The Committee therefore invites the Government to provide information on the activities of the COMUD/Handicap in relation to the matters covered by the Convention. It would be grateful to be able to examine information on the manner in which the representative organizations of employers and workers, as well as the representative organizations of and for persons with disabilities, are consulted in practice, particularly in the context of the COMUD/Handicap, on the implementation of the national strategy. It also requests the Government to indicate the impact of the measures adopted with a view to providing employment opportunities for persons with disabilities on the open labour market.
Article 4. Equality of opportunity and treatment between men and women workers with disabilities and other workers. In reply to the request made by the Committee to indicate the special positive measures taken with a view to guaranteeing effective equality of opportunity and treatment between men and women workers with disabilities and other workers, the Government reports on the legislative provisions prohibiting discrimination and the overall reform of the public administration. The Committee notes with interest that certain provisions of Act No. 012-2010/AN to protect and promote the rights of persons with disabilities envisage the adoption of measures, such as the reduction of fees for training provided by public structures (section 27), the raising of the statutory age limit for vocational training (section 28), the granting of additional time and special arrangements when passing the various exams and competitions (section 31), the introduction of a quota of jobs in the public sector (section 33) and in public and private enterprises (section 34). Furthermore, in accordance with section 8 of Decree No. 2009-530/PRES/PM/MTSS/MASSN/MS determining the conditions for the employment and training of persons with disabilities, any enterprise with 50 employees or more is required to reserve at least 5 per cent of its jobs for persons with disabilities holding a disability card. The Committee invites the Government to provide information in its next report on the implementation of the measures envisaged in the national legislation to guarantee effective equality of opportunity and treatment between men and women workers with disabilities and other workers.
Article 7. Evaluation and adaptation of vocational rehabilitation and employment services for persons with disabilities. In the report received in August 2012, the Government reiterates that state services do not have specific structures for the promotion of persons with disabilities and that they are not fully adapted to their vocational training needs, but that private action has resulted in the construction of a number of training centres for persons with disabilities. The Committee invites the Government to indicate in its next report the steps taken to ensure that state services will be provided to enable persons with disabilities to secure, retain and advance in employment.
Article 8. Rural areas and remote communities. The Government indicated previously that the whole of the national territory was covered by the implementation of the national policy for persons with disabilities, and that rural areas were therefore covered. It referred in this respect to the various associations of persons with disabilities and private bodies established and carrying out initiatives to provide education and vocational training to persons with disabilities. The Committee invites the Government to provide updated information on the measures adopted to promote the establishment and development of vocational rehabilitation and employment services for persons with disabilities in rural areas and remote communities, with an indication of the rural areas in which these services have been established, as well as particulars on their activities for persons with disabilities.
Article 9. Availability of qualified staff for persons with disabilities. The Committee once again invites the Government to provide information on any measures implemented, particularly in the context of the national strategy to protect and promote persons with disabilities adopted in July 2012, with a view to ensuring that suitably qualified vocational rehabilitation staff are made available to persons with disabilities.
Parts IV and V of the report form. Application of the provisions of the Convention in practice. The Government indicates that no studies or inquiries have been undertaken in relation to the Convention, although it refers to thematic reports on the socio-economic situation of persons with disabilities produced by the National Statistical and Demographic Institute (INSD). The Committee invites the Government to provide with its next report the information available on the application of the Convention, including statistical data on the employment of persons with disabilities, disaggregated, in so far as possible, by age, gender and the type of disability, as well as extracts from reports, studies and inquiries concerning the matters covered by the Convention.

The Committee notes with regret that the Government’s report has not been received. It hopes that a report will be supplied for examination by the Committee at its next session and that it will contain full information on the matters raised in its 2007 direct request, which read as follows:

The Committee notes the information contained in the Government’s reports received in September and November 2007, and the attached documents. In reply to the previous comments, the Government indicates that the unequal results of the action taken, both by the Government and by private institutions, led to the formulation in April 2001 of a policy based on the integration of all the needs and activities of persons with disabilities in the education, health, vocational training and employment sectors, and integration of persons with disabilities in their family environment. The Committee notes that a programme was adopted in April 2001 for the implementation of this national policy for the rehabilitation and equality of opportunity of persons with disabilities. It notes with interest that the objectives for 2006 set by the programme include “applying Convention No. 159, developing the activities of training and production centres and workshops for persons with disabilities and promoting integrated action for the integration (training–employment) in rural areas and employment of persons with disabilities”. The Government indicates that, while awaiting the implementation of this policy, the texts of laws and regulations have been adopted and that measures have been taken to promote self-employment for persons with disabilities. In this respect, the Informal Sector Support Fund (FASI) has been established which has made it possible for 228 persons with disabilities to benefit from credit facilities for investment up to a total of 98,590,000 francs. The Government also refers to the establishment of the Multi-Sectoral Committee for the Rehabilitation and Equal of Opportunities for Persons with Disabilities (COMUREC/Handicap), which is composed of representatives of the Government, organizations of persons with disabilities, technical partners and representatives of religious and customary associations. The Committee notes that the responsibilities of COMUREC/Handicap include ensuring the coordination, follow-up and evaluation of the actions taken for persons with disabilities by the various ministries (section 3 of Joint Order No. 2006/06/001/MASS/MS). The Committee trusts that the national policy of vocational rehabilitation and employment of persons with disabilities will be implemented in the near future and that the Government will be in a position to indicate the progress achieved in this respect in its next report. It also requests the Government to provide information on the measures taken, particularly in relation to vocational guidance and training, as well as employment placement, with a view to promoting the employment opportunities of persons with disabilities on the open labour market. Please also continue to provide information on the manner in which representative organizations of employers and workers, as well as organizations of and for persons with disabilities, are consulted in practice, particularly in the context of COMUREC/Handicap, on the implementation of this national policy.

The Committee notes the Government’s report received in June 2006, which refers to previous reports without providing any information in response to the comments that the Committee has been making since 2001. The Committee trusts that the Government’s next report will contain updated and relevant information on the application of the Convention in practice (Part V of the report form) and detailed information on the following points.

1. Implementation of a national policy on vocational rehabilitation and employment for persons with disabilities. In its 2001 comments, the Committee noted the existence of rehabilitation centres which are run by the State, privately or by associations of person with disabilities. The Committee asks the Government to indicate how the national policy on vocational rehabilitation and employment for persons with disabilities is implemented and what measures have been taken, particularly with regard to vocational guidance and training, and placement, to promote employment opportunities for persons with disabilities in the open labour market (Articles 2 and 3 of the Convention). Please also indicate the manner in which representative employers’ and workers’ organizations, and representative organizations of and for persons with disabilities, are consulted in practice on the implementation of this national policy (Article 5).

2. Evaluation and adaptation of vocational rehabilitation and employment services for persons with disabilities. In its 2001 comments, the Committee noted that services responsible for the matters referred to in Article 7 were regularly assessed so that they could be adapted. The Committee asks the Government to indicate in detail the content of the assessments carried out, together with the adaptations proposed, adopted or envisaged to enable persons with disabilities to secure, retain and advance in employment.

3. Rural areas and remote communities. In its previous comments, the Committee noted that bodies and associations for persons with disabilities had been established in the provinces. The Committee asks the Government to provide information on these associations and, in particular, to indicate the rural areas and remote communities in which they are based and the activities they undertake relating to vocational rehabilitation and employment services for persons with disabilities (Article 8).
