Paid Educational Leave Convention, 1974 (No. 140) - Sweden (Ratification: 1975)

Articles 2 and 5 of the Convention. Granting paid educational leave. The Government reiterates information provided in its previous report concerning amendments made to the Trade Union Representatives Act (2009:417), which entitles worker representatives to paid leave of absence so that they may undertake training related to their function. The Committee notes the Government’s indication that a new Employment Grant Ordinance (2018:42) became applicable in May 2018, which provides for special employment support to strengthen an individual’s employability in the labour market and includes support in the form of an introductory job or in the form of extra services (sections 2 and 3 of the Ordinance). The Committee also notes information provided regarding amendments to the Study Assistance Act; the Study Assistance Ordinance; and the Study Grant for full time studies for 2018. The Committee requests the Government to provide updated information on the measures taken to implement its policy on granting paid educational leave to workers for the specific purposes contemplated in Article 2(a)–(c) of the Convention. It further requests the Government to provide detailed information, including statistical information disaggregated by sex, on the manner in which the Convention is applied in practice (Part V of the report form).

Article 5 of the Convention. Granting paid educational leave. The Committee notes the Government’s report received in October 2013 in which it indicates that various Acts and Ordinances related to paid educational leave have been amended during the reporting period. These include the Employment Grant Ordinance and the Trade Union Representatives Act entitling representatives to paid leave of absence for training. The Committee notes that in May 2013 the Government presented a Bill “Study Grants in a Globalized World” proposing changes in order to create a simpler and more effective system for study grants for studies abroad. The Committee invites the Government to provide updated information on the measures taken to implement its policy on paid educational leave and other information on the manner in which the Convention is applied in practice (Part V of the report form).

Granting paid educational leave. The Committee notes the Government’s report and the reply to the 2003 direct request, including the detailed statistics, received in September 2008. It further notes the information on general measures taken, such as the abolition of the recruitment grant and the reform of the short‑term support system, to achieve a fair, coordinated and integral study support system, taking into account the needs of vulnerable groups. The Committee would appreciate receiving information on the progress made in the implementation of these measures and other relevant information on the manner in which the Convention is applied in practice (Part V of the report form).

Direct Request (CEACR) - adopted 2003, published 92nd ILC session (2004)

1. The Committee notes the Government’s reply to the 2002 direct request indicating that the proposal of Individual Learning Accounts (IKS) is still being processed at the government level. It further notes the information provided on the study support system and the grants for short-term studies for individuals who have a relatively short previous education and to stimulate further studies, administered by the trade unions and the National Agency for Special Education Support. It would appreciate continuing to receive information, in accordance with Part V of the report form, on the manner in which the Convention is applied in practice and, in this respect, asks the Government to provide extracts from any relevant reports, studies and inquiries, and available statistical data.

2. The Committee refers to the comments formulated on Convention No. 122 and would be grateful if the Government would also include in its next report on Convention No. 140 information on the steps taken to coordinate the national policy on paid educational leave with general policies on employment, education and training and hours of work (Article 4 of the Convention).

The Committee notes the Government’s report for the period ending June 2001. It notes the memorandum of the Ministry of Education concerning the establishment of a new system of educational leave as from 1 July 2001. It requests the Government to provide information on the implementation of this system, and on the adoption of the proposed system of individual competence banking (IKS) mentioned in the memorandum.

The Committee also notes the comments made by the Swedish Confederation of Enterprise and the Swedish Trade Union Confederation (LO) on the effect given in practice to the Convention. It requests the Government to continue providing information, in accordance with Part V of the report form, on the manner in which the Convention is applied in practice and, in this respect, to provide extracts from any relevant reports, studies and inquiries, and the available statistical data.

The Committee notes the Government’s report which indicates that there has been no change in the provisions on paid educational leave during the period in question. It also notes the indication that the study on the legislation applicable to various forms of leave has been transmitted to the competent authorities and the social partners for comment. It requests the Government to indicate, if appropriate in its next report, any follow-up that will be given to this consultation.

Furthermore, the Committee would be grateful if the Government would supply, as in the past, indications on the manner in which the Convention is applied in practice, supplying, for example, any extracts of relevant studies, surveys or reports, as well as the available statistics on the number of workers benefiting from paid educational leave, as requested in Part V of the report form.

Direct Request (CEACR) - adopted 1995, published 82nd ILC session (1995)

The Committee notes the Government's report which indicates that there has been no change during the reference period in existing provision on paid educational leave but that, following a review of different types of legislation on leave of absence commissioned by the Government, a new Educational Leave Act has been proposed. The Committee asks the Government to state in its next report any action taken on this proposal, indicating the reasons for it. It recalls in this connection that under Article 6 of the Convention the public authorities, employers' and workers' organizations and institutions providing education and training must be associated in the elaboration and application of the policy to promote paid educational leave.

Furthermore, the Committee would be grateful if the Government would provide, as in the past, information on the manner in which the Convention is applied in practice including, for instance, extracts from reports, studies and inquiries, and statistics on the number of workers granted paid educational leave (Part V of the report form).
