Indigenous and Tribal Populations Convention, 1957 (No. 107) - Dominican Republic (Ratification: 1958)

Display in: French - Spanish

Replies received to the issues raised in a direct request which do not give rise to further comments (CEACR) - adopted 2018, published 108th ILC session (2019)

The Committee notes the information provided by the Government, which answers the points raised in its previous direct request, and has no further matters to raise in this regard.

Direct Request (CEACR) - adopted 2014, published 104th ILC session (2015)

In reply to previous comments, the Government indicates in its report that within the population of the Dominican Republic there are no indigenous and tribal populations, for which reason it has not taken any action in relation to the Convention. The Committee observes that in Latin America the term “tribal” has been applied to certain afro-descendant communities, as indicated in the Handbook for ILO Tripartite Constituents: Understanding the Indigenous and Tribal Peoples Convention, 1989 (No. 169), published by the Office in February 2013. The Committee invites the Government to consider including information on afro-descendant communities in its report on Convention No. 107, taking into consideration that the cultural values of these communities could lie within the scope of certain provisions of the Convention.

Direct Request (CEACR) - adopted 2013, published 103rd ILC session (2014)

The Committee notes that it has not received the Government’s report for the period ending 31 May 2013. The Committee recalls that the Governing Body invited States parties to Convention No. 107 to contemplate ratifying the Indigenous and Tribal Peoples Convention, 1989 (No. 169), which would, ipso jure, involve the immediate denunciation of Convention No. 107 (GB.270/LILS/3(Rev.1), November 1997). The Committee observes that in Latin America the term “tribal” has been applied to certain communities of African descent, as indicated in the Handbook for ILO Tripartite Constituents on Convention No. 169, published by the Office in February 2013. The Committee invites the Government to indicate in its next report whether it has contemplated, with the social partners, the possibility of ratifying Convention No. 169. Furthermore, the Committee invites the Government to consider including information on afro-descendent communities in its report on Convention No. 107 taking into consideration that the cultural values of these communities could lie within the scope of certain provisions of the Convention.
[The Government is asked to reply in detail to the present comments in 2014.]
