Convention concerning Statistics of Wages and Hours of Work, 1938 (No. 63) - Guernsey

The Committee notes the supplementary information provided by the Government in light of the Governing Body’s decision at its 338th Session (June 2020). The Committee proceeded to examine the application of the Convention on the basis of the supplementary information provided this year, as well as of the information available to it in 2019.

Parts I and II of the Convention. The Committee notes the Government’s indication that there have been no noteworthy developments during the reporting period with respect to the application of the Convention, and that the data required under the Convention continues to be collected and published. The Committee welcomes the information provided by the Government in its report and invites the Government to continue to provide information on any developments regarding the application of the Convention.

In this context, the Committee recalls the recommendations of the Fourth Meeting of the Standards Review Mechanism Tripartite Working Group in September 2018, confirming the status of the Convention as an outdated instrument. It therefore welcomes the indication that the States of Guernsey will consider ratification of the Labour Statistics Convention, 1980 (No. 160), as the most up-to-date instrument on labour statistics, resulting in the automatic denunciation of Convention No. 63. It notes that this is especially opportune in light of the Governing Body’s decision at its 334th Session (October–November 2018) to place an item on the agenda of the International Labour Conference in 2024 for consideration of the abrogation of Convention No. 63, on the recommendation of the Standards Review Mechanism Tripartite Working Group. The Committee once again reminds the Government of the availability of ILO technical assistance in this regard.

Parts I and II of the Convention. The Government indicates in its report that headline data on average earnings have been published since 2011 in the States Strategic Monitoring Report and the Facts and Figures booklet, and in the Guernsey Earnings Bulletin, published annually since 2012. The Bulletin provides information on the average earnings of all employees, disaggregated by age, gender and sector. The Government further indicates that the data are supplied by the Social Security Department and include only employed persons. The averages reported relate to individuals (not households), and include full and part-time workers, providing a measure of underlying trends and changes in earnings. The Committee notes that information available to the ILO Department of Statistics indicates that labour market statistics are mainly compiled using data collated by the Rolling Electronic Census IT System and disseminated on a quarterly basis. Records from various official agencies are also used to derive statistics on labour-related topics, such as registered unemployment. The Committee welcomes the information provided by the Government in its report and invites the Government to continue to provide information on any developments regarding the application of the Convention.

The Committee notes the recommendations of the Standards Review Mechanism Tripartite Working Group and the corresponding decision of the Governing Body at its 328th Session in October–November 2016 (GB.328/LILS/2/1) calling upon the Office to commence follow-up with member States that are still bound by the Convention, encouraging them to ratify the Labour Statistics Convention, 1985 (No. 160), as the most up-to-date instrument in this area, and resulting in the automatic denunciation of Convention No. 63. The Committee reminds the Government of the availability of ILO technical assistance in this regards.

The Committee notes that the Government’s report has not been received. It hopes that the next report will contain full information on the matters raised in its previous comments.

The Committee notes that in its previous report, the Government had indicated that it regularly collects information relating to statistics on wages and hours of work through its tax and social security systems and that it carries out an annual voluntary survey of a cross-section of local businesses, with the purpose of seeking information on wages and hours of work; it also periodically obtains relevant information through its arbitration and conciliation services in the event of disputes relating to pay and conditions of work.

The Committee recalls that according to Articles 1, 5, 6, 9 and 10 of the Convention, statistics relating to wages and hours of work should be compiled, published and communicated to the ILO on a regular basis. The Committee requests the Government to communicate statistics of average earnings and of hours actually worked.

In this regard, the Committee draws the Government’s attention to Resolution I adopted by the 18th International Conference of Labour Statisticians concerning the measurement of working time. This document defines new concepts and measures in this area of statistics.

The Committee notes the Government’s report which was received at the ILO on 25 August 2010. It notes that the report is confined to indicating that no changes have occurred. In its previous report, the Government had indicated that it regularly collects information relating to statistics on wages and hours of work through its tax and social security systems and that it carries out an annual voluntary survey of a cross-section of local businesses, with the purpose of seeking information on wages and hours of work; it also periodically obtains relevant information through its arbitration and conciliation services in the event of disputes relating to pay and conditions of work.

The Committee recalls that according to Articles 1, 5, 6, 9 and 10 of the Convention, statistics relating to wages and hours of work should be compiled, published and communicated to the ILO on a regular basis. The Committee requests the Government to communicate statistics of average earnings and of hours actually worked at the earliest possible date.

The Committee notes the Government’s report and the attached "recommendations" concerning working conditions (including the rates of pay and hours of work) in horticulture, building, and hotel and catering industries. The Committee also notes the Government’s indication in its report that administrative arrangements are in place to gather the statistical information required by the Convention. It asks the Government to supply further information in this regard.

The Committee notes the Government's report and the attached "recommendations" concerning working conditions (including the rates of pay and hours of work) in construction, horticulture and the hotel and catering industry. It requests the Government to supply information about the source of these recommendations and about the extent to which the rates of pay and hours of work are actually applied.
