Direct Request (CEACR) - adopted 2020, published 109th ILC session (2021)

The Committee notes the additional information provided by the Government in light of the Governing Body’s decision at its 338th Session (June 2020). The Committee therefore examined the application of the Convention on the basis of the additional information provided as well as on the information available to it in 2019.
Articles 7 and 8 of the Convention. Employment, unemployment and underemployment statistics. Statistics of the structure and distribution of the economically active population. The Committee notes the information provided by the Government in reply to its previous comments. It notes with interest the adoption of the Statistics and Census (Jersey) Law, which came into force on 23 February 2018. In its supplementary report, the Government notes that the Jersey Annual Social Survey (JASS) has been undertaken every summer since 2005, except for 2011, when the Jersey Census was held in the same year. The Committee notes that the States of Jersey Statistics Unit continues to compile and disseminate information on the labour force, employment and unemployment, derived from various sources, including the JASS, which is used to provide periodic estimates of ILO unemployment. The Committee notes the Government’s indication that the census conducted on 27 March 2011 is still the most recent census conducted. The Committee requests that the Government continue to supply updated data and information on the methodology used in the application of Articles 7 and 8 of the Convention, as well as on plans for conducting the next round of the population census. It also reiterates its request that the Government provide information on any developments in relation to the implementation of the resolution concerning statistics of work, employment and labour underutilization (resolution I), adopted by the 19th International Conference of Labour Statisticians (October 2013), as well as on any developments in relation to the resolution concerning statistics on work relationships (resolution I), adopted by the 20th International Conference of Labour Statisticians (October 2018).
Articles 9, 10, 11 and 12. Current statistics of average earnings and hours of work. Statistics of time rates of wages and normal hours of work. The Committee notes the information communicated by the Government with respect to statistics on average earnings, hours worked (from the 2011 Jersey census), labour costs (from the annual survey of financial institutions) and the retail price index. With respect to Article 9(1), the Government indicates that the Average Earnings Index (AEI) continues to be compiled annually. Information from the AEI is available online and includes information on the level of average weekly earnings and changes in average earnings overall, disaggregated by individual business sector. The Government indicates that the coverage of the average earnings survey extends to about half of all workers in Jersey. The Committee notes that the most recent report of the AEI was published in 2017. With respect to the application of Article 9(2), the Committee notes the Government’s indication that statistics of hours of work were compiled from the 2011 census and the results made available online. The Committee recalls the Government’s indication in its previous report that statistics of time rates of wages were not compiled, but that an independent consultative body, the Employment Forum, had been established by law in 2003, and is charged with reviewing the rates of minimum wages on the island, particularly in low-paid industries. With respect to Article 11, the Government indicates that the finance industry accounts for more than two fifths of Jersey’s total gross value added, and that an annual survey of financial institutions continues to be undertaken by Statistics Jersey each spring. The survey includes information on labour costs for the finance industry sector, as well as for subsectors such as banking, trusts and company administration, fund management, accounting and legal services. With respect to Article 12, a Retail Price Index continues to be published on a quarterly basis by the States of Jersey Statistics Unit, and is made available online. The Committee requests the Government to communicate statistics to the ILO as soon as they become available and, following enactment of the recent Statistics and Census (Jersey) Law, to provide information on any measures taken or envisaged to improve and enhance the collection, compilation and publication of the statistics required under these Articles of the Convention.

Articles 7 and 8 of the Convention. Employment, unemployment and underemployment statistics. Statistics of the structure and distribution of the economically active population. The Committee notes the information provided by the Government in reply to its previous comments and notes that the States of Jersey Statistics Unit compiles and disseminates information on the labour force, employment and unemployment, derived from various sources, including the Jersey Annual Social Survey. Employment statistics are also derived from references to jobs filled, based upon the manpower returns submitted through activities undertaken, as required by the Control of Housing and Work (Jersey) Law 2012. These figures are included in the Jersey Labour Market Report, which is published twice a year. In addition, the Social Security Department publishes monthly registered unemployment figures that refer to the number of people registered as actively seeking work. The Committee further notes that data derived from population censuses are regularly compiled, and the results of the censuses are regularly supplied to the ILO Department of Statistics for dissemination on its website (ILOSTAT). The latest Population Census was conducted on 27 March 2011. The Committee requests that the Government continue to supply updated data and information on the methodology used in the application of these provisions, as well as on plans for conducting the next round of the population census. It also invites the Government to provide information on any developments in relation to the implementation of the Resolution concerning statistics of work, employment and labour underutilization (Resolution I), adopted by the 19th International Conference of Labour Statisticians (October 2013).
Articles 9, 10, 11 and 12. Current statistics of average earnings and hours of work. Statistics of time rates of wages and normal hours of work. With respect to Article 9(1), the Government indicates that an Average Earnings Index (AEI) is compiled annually. Information from the AEI is available online and includes information on average weekly earnings and changes in average earnings overall, disaggregated by business sector. The latest round of the AEI took place in 2013. The Committee notes, however, that statistics on average earnings from this round have not yet been transmitted to the ILO. It notes further that no information has been provided in the Government’s report with respect to Article 9(2). The Committee recalls the Government’s indication in its previous report that statistics of time rates of wages were not compiled, but that an independent consultative body, the Employment Forum, had been established by law in 2003, and is charged with reviewing the rates of minimum wages in the island, particularly in low-paid industries. The Committee understands that the Forum recommended a 2.8 per cent increase in the minimum wage as of 1 April 2016 for all workers over the age of 16. The Committee also notes that the information provided by the Government on annual wages by economic sector are not relevant to its application of Article 10. With respect to Article 11, the Government indicates that an annual survey of financial institutions continues to be undertaken each spring, and the survey includes information regarding labour cost for this sector. With respect to Article 12, a Retail Price Index is published on a quarterly basis by the States of Jersey Statistics Unit, and is available online. The Committee requests the Government to communicate statistics to the ILO as soon as they become available and to provide information on any measures taken or envisaged to improve and enhance the collection, compilation and publication of the statistics required under Articles 9, 10 and 11. It also requests the Government to continue to supply updated statistics with respect to Article 12.

The Committee notes that the Government’s report has not been received. It hopes that the next report will contain full information on the matters raised in its previous comments.

Article 7 of the Convention. Compilation of statistics of employment. The Committee requests the Government to supply methodological information on the Jersey Annual Social Survey as soon as possible.
Articles 9, 10 and 11. Compilation of statistics of time rates of wages and normal hours of work wage, structure and distribution and labour costs. The Committee notes the Government’s statement that statistics of time rates of wages are not currently compiled, but the Employment Forum (an independent consultation body) has been established by law in 2003 with a view to doing research and making recommendations in relation to the minimum wage. This Forum is responsible for reviewing the rates of minimum wages, and in particular in certain low paid industries in the Island. It also notes the limited information provided on the application of Articles 10 and 11. The Committee requests the Government to provide information on any measures taken or envisaged to improve and enhance the collection, compilation and publication of statistics governed by Articles 9, 10 and 11.
Furthermore, the Committee draws the attention of the Government to Resolution I[1] and [2] concerning the measurement of working time adopted by the 18th International Conference of Labour Statisticians in November–December 2008, which defines new concepts and measures in this area of statistics.
Article 12. Consumer price indices. The Committee notes the information supplied by the Government and requests the Government to continue to provide information on retail price indices for all items and main groups (Article 5), as well as detailed information on the methodology used for these statistics (Article 6).

Article 7 of the Convention. Compilation of statistics of employment. The Committee notes the information supplied by the Government as well as the relevant information contained in the report published on the statistics Unit website. It requests the Government to supply methodological information on the Jersey Annual Social Survey as soon as possible.
Articles 9, 10 and 11. Compilation of statistics of time rates of wages and normal hours of work wage, structure and distribution and labour costs. The Committee notes the Government’s statement that statistics of time rates of wages are not currently compiled, but the Employment Forum (an independent consultation body) has been established by law in 2003 with a view to doing research and making recommendations in relation to the minimum wage. The Committee notes the Government’s report and the partial replies to its previous comments. It would be grateful if the Government would supply supplementary information on the following matters.

Article 7 of the Convention. The Government is requested to supply statistical information on unemployment, along with the associated information, namely the title and reference number of the main publication which contains detailed descriptions of sources, concepts, definitions and the methodology used in collecting and compiling the statistics (Articles 5 and 6).

Articles 9, 10 and 11. The Committee notes that the annual survey containing information on labour costs in the financial institutions sector is conducted every spring and requests the Government to continue to keep the ILO informed of any measure designed to improve the collection, compilation and publication of the statistics mentioned in these three Articles of the Convention.

Article 12. The Committee requests the Government once again to regularly supply the ILO with retail price indices for all items and main groups (Article 5), as well as detailed information on the methodology used for these statistics (Article 6).

Direct Request (CEACR) - adopted 2000, published 89th ILC session (2001)

The Committee notes the information provided in the Government’s report. It asks the Government to provide further information on the following points.

Article 7.  Noting that data on registered unemployment are currently collected and published by the Social Security Department, the Committee again asks the Government to send the data and methodological information to the ILO, in accordance with Articles 5 and 6.

Articles 9, 10 and 11.  The Committee notes that the requirements of Article 9, paragraph 1, are fulfilled to a limited extent by the compilation and publication of: (a) an annual Average Earnings Index; and (b) statistics of usual weekly hours of work compiled from the five-yearly census.

The Committee notes that statistics of time rates of wages and normal hours of work (Article 9, paragraph 2), wage structure and distribution (Article 10) and labour cost (Article 11) are not compiled, although the Government indicates in its report that they may become necessary and feasible when a minimum wage is introduced in the future. The Committee asks the Government to keep the ILO informed of measures contemplated, if any, to improve and enhance the collection, compilation and publication of the statistics covered by these three Articles.

Article 12.  The Committee notes the general information about the Retail Price Indices (RPI) in reply to its previous comment. It asks the Government to provide regularly to the ILO RPI for All-items and the major groups (as required under Article 5), as well as detailed methodological information relating to this series (as required under Article 6).

Article 13.  The Committee notes that on the basis of the information available, this Article appears to be partly applied. It notes, however, that no survey report has been published in the past, although there are plans to publish a report in the future. The Committee asks the Government to supply information on (i) when the last survey was carried out and when the next one is planned; and (ii) when the survey report is going to be published. It also asks the Government to submit a copy of this report to the ILO as soon as it becomes available (in accordance with Article 5).

Article 14.  The Committee notes the statistics on the total number of industrial accidents and the number of days lost appearing in the "Annual Report of the Health and Safety Inspectorate". It again asks the Government to indicate whether employers’ and workers’ organizations are consulted in matters concerning these statistics (as required under Article 3), and also to provide methodological information (as required under Article 6).

Article 15.  The Committee recalls that the Convention is applied with modification, as a result of which statistics of industrial disputes are not compiled. It asks the Government to keep it informed of any steps it plans to take in the future to compile statistics on strikes and lockouts.

Direct Request (CEACR) - adopted 1995, published 82nd ILC session (1995)

With reference to its previous comments, the Committee notes the information supplied by the Government concerning Articles 2, 3 and 5 of the Convention. It requests the Government to provide further information on the following points.

Article 7. The Committee asks the Government to provide the Office with technical information on the definition and methodology used concerning the current statistics of the economically active population in accordance with Article 6.

Articles 9, 10 and 11. The Committee asks the Government to provide more detailed information on: (i) the annual survey which provides basic data for the average earnings index introduced in 1990, including the published statistics and information concerning their publication (as required under Article 5), and detailed description of the sources, concepts, definition and methodology used (as required under Article 6); and (ii) the amount of information on wage structure and distribution and on labour cost which can be obtained from the earnings index.

Article 12. The Committee requests the Government to supply the published statistics of the Retail Price Indices for all items and the major groups (as required under Article 5), as well as detailed methodological information relating to this series (as required under Article 6).

Article 13. The Committee asks the Government to supply more detailed information on the household expenditure survey particularly methodological information (as required under Article 6).

Article 14. The Committee requests the Government to provide (a) information concerning the types of data collected; and to indicate whether data relating to fatal injuries and time lost as a result of work injuries are collected or available and, if not, to indicate whether it is intended to extend the scope of the statistics to include this information. It also requests the Government to indicate whether employers' and workers' organizations are consulted in matters concerning these statistics (as required under Article 3). Furthermore, the Committee requests the Government to provide methodological information (as required under Article 6), and in particular, information concerning the source of the data, the concepts, the data collection processes, and the bodies responsible at the various stages of these processes.

Article 15. The Committee recalls that the Convention is applied with modification, as a result of which statistics of industrial disputes are not compiled. It would be grateful to the Government if it would provide information on any system which may already exist to give effect to this Article or on any plans in this connection, in accordance with Article 16(4).

Direct Request (CEACR) - adopted 1993, published 80th ILC session (1993)

The Committee notes the information supplied by the Government with its first report. It requests the Government to provide, with its next report, further information on the following points:

Article 2 of the Convention. The Committee requests the Government to indicate, for each of the Articles of Part II, which specific ILO standards and guidelines have been followed and the reasons for any departures from them.

Article 3. The Committee requests the Government to indicate, for each of the Articles of Part II, the manner in which the employers' and the workers' organizations, if any, were consulted.

Article 5. The Committee requests the Government to communicate to the ILO, in respect of each of Articles 7 to 14, the published statistics and information concerning their publication.

Article 6. The Committee also requests the Government to communicate to the ILO, in respect of each of Articles 7 to 14, detailed descriptions of the sources, concepts, definitions and methodology used.

Articles 7 and 8. The Committee notes the data on registered unemployment and on the economically active population supplied with the report, and asks the Government to indicate: (i) the frequency of population censuses; (ii) the exact date of the last population census and (iii) whether more detailed statistics are available from the population censuses (e.g. by sex and age group, by industry, sex and status in employment).

Articles 9 to 11. The Committee notes that these Articles have been declared applicable with modification: i.e. the statistics concerned are not compiled on a comprehensive basis. It notes, however, that some information has been available through the wages index and the average earnings index. The Committee requests the Government to supply further details on these existing indices and information on any development towards the compilation of statistics on a comprehensive basis.

Article 14. The Committee requests the Government to indicate the statutory framework for collecting and compiling statistics of occupational injuries, the types of data collected and the coverage of the statistics.
