Allegations

The complainant organizations allege that the Government has passed a law (Act respecting conditions of employment in the public sector, S.Q. 2005, chapter 43) imposing conditions of employment on employees in the Quebec public sector without prior bargaining or consultation; violating their fundamental right to bargain collectively; taking away their right to strike without granting them an alternative procedure for the settlement of disputes such as mediation, conciliation or arbitration. The Association of Attorney-General’s Prosecutors of Quebec (ASPGQ) further alleges that the Prosecutors Act (as amended by the Act amending the Act respecting Attorney-General’s Prosecutors and the Labour Code, L.Q. 2004, chapter 22) denies prosecutors the right to join a trade union and deprives them of protection against hindrances, reprisals or sanctions related to the exercise of trade union rights
