1. 81. This case, already considered by the Committee at its 25th Session (May 1960) ", was further examined by the Committee at its meeting on 23 February 1961, when the Committee submitted the conclusions contained in paragraphs 30 to 42 of its 52nd Report, which was approved by the Governing Body at its 148th Session (March 1961).

A. A. The complainants' allegations

1. 82. Paragraph 42 of the Committee's 52nd Report reads as follows:
2. 42. As regards the case as a whole, the Committee recommends the Governing Body:
   • (a) to take note of the Government's statement that a Federation of Workers of the Board of Management for the Port of Rangoon has now been registered and has been recognised by the employers concerned;
   • (b) to take note of the Government's statement that it intends to enact a new Public Service Bill and that, when it is enacted, it may possibly do away with or override some or all of the existing provisions of the Government Servant's Conduct Rules, to bring this statement to the notice of the Committee of Experts on the Application of Conventions and Recommendations, and to request the Government to be good enough to keep the Governing Body informed of further developments in this connection;
   • (c) to bring the provision of the new Bill to amend the Trade Unions Act, the text of which the Government has furnished, to the notice of the I.L.O. Committee of Experts on the Application of Conventions and Recommendations, so that it may take account of them when considering the question as to the compatibility of the texts previously brought to its notice with the provisions of the Freedom of Association and Protection of the Right to Organise Convention, 1948 (No. 87), ratified by Burma, and to request the Government to be good enough to keep the Governing Body informed of further developments in this connection.
3. 83. This decision of the Governing Body was brought to the notice of the Government of Burma by a letter dated 13 March 1961.
4. 84. The Government forwarded further information by a letter dated 27 May 1961.
5. 85. In this letter the Government states that, with a view to enacting the new Public Service Bill, the Public Service Reorganisation Commission, which recently returned to Burma after studying how the public services are constituted and function in other countries, is now preparing, on the basis of its findings in the countries visited, a report for submission to the Government, and that the Government will be able to take up the question of enacting the new Public Service Bill only after it has received this report.
6. 86. The Government states further that the proposed draft Bill to make further amendments to the Trade Unions Act is still being considered by the Government.

The Committee's recommendations

1. 87. In these circumstances the Committee recommends the Governing Body:
   • (a) to take note of the Government's statement that, with a view to enacting the new Public Service Bill, the Public Service Reorganisation Commission is preparing a report for submission to the Government on the basis of its findings in a number of countries visited by the Commission for the purpose of studying how their public services are constituted and function, and that the Government will be able to take up the question of enacting the new Public Service Bill only after it has received the report in question;
   • (b) to take note also of the Government's statement that the proposed draft Bill to make further amendments to the Trade Unions Act is still being considered by the Government;
   • (c) to bring the aforesaid statements by the Government to the notice of the I.L.O. Committee of Experts on the Application of Conventions and Recommendations, and to request the Government to be good enough to keep the Governing Body informed of further developments with respect to the proposed enactment of a new Public Service Bill and of a Bill to amend the Trade Unions Act.
