  1. 165. The Committee last examined this case at its March 2001 meeting when it noted with satisfaction the prospects of a technical assistance mission to the country in respect of the implementation of the judgement of the Constitutional Court of Ukraine which had declared unconstitutional the clauses of sections 11 and 16 of the Trade Unions Act which restricted the right to freedom of association [see 324th Report, paras. 85-87].
  2. 166. In a communication dated 23 August 2001, the Government indicates that sections 11 and 16 of the Trade Unions Act are in the process of being amended and that the drafting process will take into account the conclusions of the ILO technical assistance mission which was undertaken in April 2001.
  3. 167. The Committee notes with interest the Government’s statement that the proposed amendments to the Trade Unions Act will take into account the conclusions of the ILO technical assistance mission. The Committee draws the attention of the Committee of Experts on the Application of Conventions and Recommendations to the proposed amendments to sections 11 and 16 of the Trade Unions Act.
