The Committee last examined this case at its meeting in November 2006 [see 343rd Report, paras 196 and 198] and at that time requested the Government to keep it informed of the ruling of the Court of Administrative Proceedings with regard to the appeals lodged against the General Labour and Social Security Inspectorate Decree of 28 April 2003, which sanctioned the Savings and Loans Cooperative of Officials of the Armed Forces (CAOFA) for having dismissed workers because of their trade union membership.

In its communication dated 21 February 2007, the Government reports that the Court of Administrative Proceedings has still not issued a ruling on the appeals lodged against the General Labour and Social Security Inspectorate Decree of 28 April 2003, as the documents are still being examined by the judges of the court. The Government adds that in the context of the proceedings, the State Prosecutor to the Court of Administrative Proceedings indicated in his report of 16 November 2006 that he believes the appeal will be rejected and the allegations will be confirmed; nevertheless, the court is the competent authority and it will rule as it sees fit.
- 189. The Committee notes this information and hopes that the Court of Administrative Proceedings will issue a ruling in the near future regarding the dismissal of workers because of their trade union membership, and it requests the Government to keep it informed of the ruling.
