Effect given to the recommendations of the Committee and the Governing Body

1. 175. The Committee last examined this case at its meeting of November 2007 [see 346th Report, paras 187–189]. On that occasion it expressed the hope that the Court of Administrative Proceedings would issue a ruling in the near future on the appeals lodged against the General Labour and Social Security Inspectorate Decree of 28 April 2003, which sanctioned the Savings and Loans Cooperative of Officials of the Armed Forces (CAOFA) for having dismissed workers because of their trade union membership, and requested the Government to keep it informed of the ruling.
2. 176. By a communication of 23 May 2008, the Government sent a copy of the ruling handed down by the Court of Administrative Proceedings in “CAOFA v/the State – Ministry of Labour and Social Security”, upholding the impugned decision (the General Labour and Social Security Inspectorate Decree penalizing CAOFA with a fine for breach of Conventions Nos 87 and 98).
