  1. 19. The Committee last examined this case at its March 2012 meeting [see 363rd Report, para. 289], when it made the following recommendation:
    • Regretting that the proceedings (both administrative and judicial) concerning the application by the Association of Banks’ Senior Staff Officers (APJBO) for trade union status have been under way for more than eight years (according to the complainant, the application was filed in March 2004), the Committee requests the Government to send it a copy of the judgment of the Supreme Court of Justice of the Nation concerning the appeal filed by the complainant organization, as soon as it is issued.
  2. 20. In its communications of 9 August 2012 and March 2013, the Government stated that: (1) the case known as Ministry of Labour v. Association of Banks’ Senior Staff Officers concerning the Trade Union Associations Act is still before the Third Chamber of the National Labour Appeals Tribunal; (2) it should be noted that the final judgement of 30 November 2010, which was handed down by the aforementioned judicial authority, was overturned by the Supreme Court of Justice of the Nation as a result of the extraordinary federal appeal filed by the complainant organization; (3) on 16 April 2012, the proceedings were returned to the Third Chamber of the National Labour Appeals Tribunal in order for a new judgment to be handed down; (4) on 14 August 2012, the Third Chamber rejected the extraordinary federal appeal filed by the APJBO; and (5) the Government consulted the Supreme Court of Justice which indicated that no appeal had been registered to date. The Committee takes note of this information.
