Unemployment Convention, 1919 (No. 2) - Poland (Ratification: 1924)

The Committee notes the observations made by the Independent and Self-Governing Trade Union “Solidarność”, received on 2 September 2014, and the Government’s reply to these observations.

Article 2(2) of the Convention. Coordination of the activities of public and private employment services. The Government provides in its report information on the legislative changes introduced in 2014 to the Act on Employment Promotion and Labour Market Institutions. The Committee notes that the changes aim to improve the situation on the labour market by introducing new measures to support job creation and provide assistance to the unemployed. In its observations, Solidarność indicates that there is weak control over the activities of temporary employment agencies, adding that workers employed by these agencies are the most vulnerable in terms of poverty and social exclusion. In its reply, the Government recalls that the activities of employment agencies are regulated by the provisions of the Act of 2 July 2004, as amended, and the activities of temporary employment agencies are regulated by the Act of 9 July 2003, as amended. The Committee notes in this regard the information provided on the role played by the National Labour Inspectorate to supervise the effective application of legislation, to identify possible breaches and to fine non-compliant private employment agencies and temporary employment agencies. The Committee refers to its comments on the application of the Private Employment Agencies Convention, 1997 (No. 181), and requests the Government to continue to provide in its report on Convention No. 2 information on the measures taken to ensure effective coordination of the activities of public and private employment services with a view to combating unemployment.
