Articles 2 and 5 of the Convention. Effective tripartite consultations. The Committee welcomes the information provided by the Government in its first report. The Government indicates that the most representative organizations of employers and workers for purposes of the Convention are the Uzbekistani Confederation of Employers and the Federation of Trade Unions of Uzbekistan (FPU). It adds that the views of employers’ and workers’ organizations are taken into account throughout the process of developing national policy, legislation and practical measures in the field of social and labour relations. With respect to the application of the Convention, the Government reports that all three of the tripartite partners participate in the process of preparing Government reports on ratified ILO Conventions. The Committee notes the Regulation establishing the National Tripartite Commission on Social and Labour Issues, which is composed of equal numbers of representatives of employers and workers. The main tasks of the National Tripartite Commission include: carrying out tripartite consultations and discussing draft laws and regulations on social and labour matters; carrying out consultations on matters relating to the ratification and implementation of international labour standards. With respect to consultations on international labour standards under Article 5(1), the Government indicates that tripartite consultations are held on all matters relating to the activities of the ILO. The Committee notes the Government’s indication that the National Tripartite Commission held by videoconference on 9 April 2021 included a representative of the ILO. The Commission discussed the implementation of the Decent Work Country Programme for Uzbekistan 2014-2020, as well as the draft Decent Work Country Programme for 2021-2025. Ratification of the Promotional Framework for Occupational Safety and Health Convention, 2006 (No. 187) and the Maternity Protection Convention, 2000 (No. 183) were also discussed. The Committee notes with interest the ratification of Convention No. 187 following tripartite consultation. In addition, the Government indicates that the National Tripartite Commission meets at least twice a year. The Committee requests the Government to continue to provide updated information on the content, frequency and outcome of the tripartite consultations held on international labour standards pursuant to Article 5 of the Convention.
Article 3(1). Freely chosen representatives. Information has not been provided to enable the Committee to assess whether or not Article 3(1) is fully applied. The Committee requests the Government to provide information on the procedures adopted to select the representatives of each party.
Article 3(2). Equal representation. The Government indicates that the National Tripartite Commission is composed of representatives of “at least seven people with decisive votes from each party, including one co-chairperson. The number of representatives is based on the principle of equality”. The Committee notes that the information provided by the Government does not allow to determine precisely if each party is represented on equal footing during tripartite consultations. The Committee therefore requests the Government to provide information regarding the manner in which the principle of equal representation among the tripartite groups is given effect.
Article 4(1). Administrative support. The Government indicates that the secretariat is the working body of the National Tripartite Commission. It is composed of three chairpersons, one from each party. The secretariat prepares for the Commission meetings, oversees implementation of the Commission’s decisions, informs Commission members of current activities, prepares the Commission’s work plans, carries out the Commission’s work, liaises operationally with public and administrative bodies, employers and personnel organizations, as well as with public and administrative authorities, as appropriate. The Committee requests the Government to provide information on the provision of administrative support provided to the secretariat as well as to all members of the National Tripartite Commission.
Article 4(2). Financing of necessary training. The Government indicates that members of the National Tripartite Commission participated in a sub-regional seminar held in the Russian Federation in December 2019 organized by the ILO, on the topic of promoting tripartite social dialogue. The Committee requests the Government to provide updated information on the content, frequency and impact of other similar trainings held.
Article 6. Annual report. No information has been provided with respect to the publication of an annual report on the working of the procedures provided for in the Convention. The Committee requests the Government to provide updated information in its next report on the manner in which effect is given to this Article of the Convention.
