- 3. In its 38th Report adopted on 9 November 1959, the Committee recommended the Governing Body to take an immediate decision on the urgent aspects of Case No. 156 relating to France (Algeria) and to request the French Government to furnish certain information as a matter of urgency.
- 4. By a letter dated 16 November 1959 received on 17 November, the French Government transmitted to the Director-General its observations on the matters which the Committee, in its 38th Report, regarded as urgent.
- 5. It appears from the information now furnished by the French Government that a full inquiry into the circumstances of the death of Mr. Aissat Idir has been made by the Committee for the Safeguard of Individual Rights and Liberties. The Government gives details of the findings of this committee, which has reported that the allegation that he was tortured is not based on fact and that he received the best medical attention. A judicial inquiry instituted by the Public Prosecutor's Office of Algiers has not yet been completed.
- 6. The French Government also states that, following proceedings before the examining magistrate in Blida involving 28 persons, Mr. Ali Yayia was charged on 24 September last with offences against the external security of the State, wilful assault and the coercion of certain of his co-religionists and that judicial proceedings in respect of his case are pending.

In these circumstances, the Committee, having made a preliminary examination of the reply of the French Government and considering it necessary to examine more fully the reply which has been received and certain further information which the Committee proposes to seek from the French Government, will continue to treat the case as one of urgency and recommends the Governing Body to consider it further at its next session on the basis of a further report from the Committee.
