- 19. The Committee last examined this case at its May 1999 meeting (see 316th Report, paras. 196-213). It had requested the Government to review the situation of the dismissed trade union leaders and workers of the Tack Fat Garment Factory and the factory of Samhan Fabrics Co. Ltd. within the framework of impartial procedures and to introduce in its legislation measures granting effective protection against acts of anti-union discrimination.

In a communication dated 12 August 1999, the Government states that concerning the dismissals of the trade union leaders and workers of the Tack Fat Garment Factory and the factory of Samhan Fabrics Co. Ltd., the Ministry of Labour has done everything it could to settle them by complying with the labour law provisions and the relevant ministerial orders and that it has already sent detailed reports to the Committee in this respect. Nevertheless, in order to ensure impartiality in the settlement of the above disputes, the Government is requesting technical assistance from the Office.

Concerning legal measures granting effective protection against acts of anti-union discrimination, the Government explains that legal provisions do exist in the Cambodian Labour Code, particularly articles 279-282 and 292-294. The Government insists that those guilty for violating the abovementioned provisions are liable to severe fines and/or imprisonment to up to one month. These penalties are spelled out in articles 369, 373 and 380 of the Labour Code.
- 22. The Committee takes due note of this information and will transmit the request for technical assistance to the competent bodies of the Office.
