  1. 107. The Committee examined this case relating to the dismissal of trade unionists following the establishment of a trade union committee and anti-union repression at its June 2001 meeting [see 325th Report, paras. 448-462]. On that occasion, the Committee requested the Government to take all necessary measures to ensure that the ruling handed down by the relevant court – if the ruling confirmed the labour inspectorate’s conclusion that a violation of freedom of association had been committed in the Fruit of the Loom company – was fully and effectively applied and that the eight trade union officers were reinstated in their respective jobs without loss of pay and with full compensation. The Committee also requested the Government to keep it informed of developments in regard to the attitude of the Governor of the town of Salé who had made statements against trade unions and acted in an anti-union manner, in particular with regard to the trade union members of the Fruit of the Loom company in the town of Salé.

In its communication dated 21 September 2001, the Government states that, in accordance with the legislation in force, the two reports of the labour inspectorate of their meetings with the employer were transmitted to the relevant court and that the Committee will be informed of the ruling handed down by this court as soon as this takes place. Moreover, the Government states that the employees involved in this action have submitted a case to the courts for compensation for wrongful dismissal.
  3. 109. The Committee takes note of this information. It once again requests the Government to inform it of the decision of the court on the two records submitted by the labour inspectorate, and of the ruling on the case brought before the court by the employees for compensation for wrongful dismissal. Finally, the Committee requests the Government to keep it informed of the measures taken or envisaged with regard to the allegations of anti-union behaviour on the part of the Governor of the town of Salé.
