The Committee last examined this case concerning allegations of the promotion of trade union organizations in the construction sector that were composed of persons engaged in violent and criminal activities, at its meeting in October 2016 [see 380th Report, paras 68–71]. On that occasion, the Committee requested the Government to keep it informed of the outcome of the investigations and criminal proceedings in relation to the murder of Mr Jesús Aníbal Ruiz Díaz and the injuries suffered by Mr Jorge Sánchez Ramírez. It also requested the Government to report on the initiatives adopted in relation to the allegations of violence and threats made against trade union leaders and members in the construction sector.

By communications dated 25 May 2017 and 1 July and 20 November 2019, the Government sent information on the criminal proceedings instituted in connection with the murders of Mr Ruiz Díaz, a leader of the Federation of Civil Construction Workers of Peru (FTCCP), and Mr Sánchez Ramírez, a member of the FTCCP, who died of his injuries. The Government indicates that by a judgment dated 10 January 2019, the Collegiate Criminal Court of Barranca sentenced Mr Miguel Ángel Lastra Villegas to 23 years’ imprisonment for the offence of aggravated homicide to the detriment of Mr Sánchez Ramirez and as a co-perpetrator of the offence of aggravated homicide to the detriment of Mr Ruiz Diaz. Mr Juan Neeslander Mendoza Santiago was sentenced to six years’ imprisonment for the offence of illegal possession of a firearm and ammunition to the detriment of the State. The Government indicates that, following an appeal, this sentence was confirmed at second instance on 17 October 2019.
  3. 43. The Committee takes due note of the information provided by the Government and understands that the above-mentioned judgments are final.
  4. 44. While noting that the Government has not provided information on initiatives taken with respect to the allegations of violence and threats against trade union leaders and members in the construction sector, the Committee notes that in the context of Case No. 2982, examined by the Committee hereafter, the Government of Peru has reported on measures taken to address the issue of violence in the civil construction sector. On the basis of the foregoing, and to the extent that Case No 2982 continues to be followed up, the Committee considers the present case closed and will not pursue its examination.
