The Committee notes with regret that the Government’s report has not been received. It hopes that a report will be supplied for examination by the Committee at its next session and that it will contain full information on the matters raised in its previous direct request, which read as follows:
1. The Committee notes the Government’s 1997 report which continues to be very brief and does not address the points raised by the Committee in its previous comments. The Committee notes the Government’s statement that the Convention is covered by the EC Machinery Directives No. 89/392 as amended by Nos. 91/368, 93/44 and 93/68. It recalls however the obligation of member States, under article 22 of the Constitution of the ILO, to make reports on the measures which they have taken to give effect to the provisions of the Conventions to which they are party in the form indicated by the Governing Body of the ILO. In this regard the Committee wishes to draw the Government’s attention to paragraph 60 in the General Part of its 1997 report where it indicated that the incorporation of regional standards on safety and health into national legislation was not always sufficient to meet the requirements of international standards of the ILO. In order for the Committee to verify the effect given to the provisions of this Convention it requests the Government to provide detailed reports containing information requested on each of the Articles of the Convention, on the provisions of the legislation and regulations referred to by the Government and on any other measures related to the application of these Articles.
2. Article 2, paragraph 4, of the Convention. The Committee notes that the Government’s report does not reply to its previous comments. It recalls that section 3(4)(2) of Notice No. 2.2.0.1 on machinery and plants provides for the shielding with appropriate safeguards of a number of dangerous parts of machines, including flywheels, gears, rollers, cylinders, pulleys, belt drives and chains. It requests the Government to indicate the measures taken to guard the other parts mentioned in this paragraph of Article 2 of the Convention, including set-screws, bolts, keys, cams, pinions, crank arms and side blocks.
3. The Committee would be grateful if the Government would communicate copies of Order No. 561 of 24 June 1994 and of Order No. 669 of 7 August 1995, "Design of technical equipment" which were mentioned as enclosed in the Government’s 1997 report but which had not reached the Office.
