Articles 3(1), 10 and 16 of the Convention. Primary functions of the system of labour inspection. Number of labour inspectors. Frequency and thoroughness of inspections. Following its previous comment, the Committee notes the Government’s indication in its report that the implementation of the Business Plans of the Health and Safety Executive (HSE) 2020–22 was impacted by the COVID-19 pandemic but that the measures specified within its core aims were met. The Committee also notes that the core objectives of the Business Plan 2020-22 are reflected in the new Business Plan 2023–25. The Committee further notes the Government’s indication that as of 31 May 2023, the HSE included one Chief Health and Safety Officer, two Health and Safety Inspectors and one trainee Health and Safety Inspector. The Committee further notes the statistics provided by the Government for 2021, which include details on the number of inspections conducted, the type of inspections, the nature of workplaces covered, as well as the number of follow up inspections. The Committee also notes the information provided on the enforcement activities, including details on the number of court cases and notices issued. The Committee takes notes of the information provided by the Government, which addresses its previous request.
Articles 20 and 21. Annual report on the work of the inspection services. The Committee notes that the HSE maintains and publishes a record of inspection statistics, and accident and license statistics, which includes statistics of inspection visits, violations and penalties imposed and industrial accidents. The information on staff of the labour inspection service is included in the Business Plans published by HSE. The Committee also notes that the statistics of workplaces liable to inspection and number of workers therein are published separately by the Government, in the Guernsey Quarterly Population, Employment and Earnings Bulletin. It observes, however, that there are no statistics concerning occupational diseases (Article 21(g)). The Committee therefore requests the Government to ensure that the labour inspection report contains information with regard to occupational diseases and to provide information in this respect.
