Article 2(3) of the Convention. Ratification of relevant ILO occupational safety and health (OSH) Conventions. Further to its previous comment, the Committee notes the indication in the Government’s report that it is committed to levelling up OSH laws and regulations in consultation with the various ministerial departments and the most representative employers’ and workers’ organizations so that the legislative framework is in conformity with international labour standards. The Government indicates that this will also provide the opportunity to ratify the relevant ILO OSH Conventions. The Committee requests the Government to continue providing information on any new developments in this regard and on the consultations held with the most representative employers’ and workers’ organizations. The Committee once again recalls that in June 2022 the International Labour Conference added the principle of a safe and healthy working environment to the fundamental principles and rights at work, thereby amending the ILO Declaration on Fundamental Principles and Rights at Work of 1998. In this regard, the Committee reminds the Government that it may avail itself of ILO technical assistance with a view to bringing the applicable law and practice into conformity with the fundamental OSH Conventions and accordingly promoting their ratification and effective application.
Article 4(2)(a). Laws and regulations. Further to its previous comments concerning the Framework OSH Bill, the Committee notes the Government’s indications that, over the past two years, the Department of Employment has held consultative meetings with the ministerial departments concerned by the scope of application of the Framework OSH Bill. The Government indicates that, following these meetings, a Framework OSH Bill has been finalized and will be submitted to the specialized bodies for validation. The Committee requests the Government to continue providing information on developments in relation to the adoption of the Framework OSH Bill and to provide a copy when it has been adopted.
Article 4(3)(f) and (g). Collection and analysis of data on occupational injuries and diseases. Collaboration with insurance and social security schemes. Further to its previous comment on this subject, the Committee notes the Government’s indications concerning the measures adopted to improve the collection and analysis of data and to strengthen collaboration with insurance and social security schemes. According to the Government, a study has been undertaken with the technical assistance of the International Labour Office to identify the strengths and weaknesses of the system for the notification of employment accidents and occupational diseases and to explore ways of improving it. The Government adds that a comparative study on occupational diseases at the national and international levels has been undertaken in the context of the National OSH Programme 2020–24. The Committee also notes that, according to the Government, Bill No. 27.23 to amend Act No. 18-12 on occupational injury compensation was adopted by the Government Council on 20 July 2023. The Committee requests the Government to indicate the measures adopted as a result of the study undertaken on the improvement of the system for the notification of occupational accidents and diseases. It also requests the Government to indicate the impact of these measures on the functioning of the system for the collection and analysis of data on occupational injuries and diseases. The Committee further requests the Government to continue providing information on any amendment to Act No. 18-12 on occupational injury compensation, including any impact that the amendment has on collaboration with insurance and social security schemes.
Article 4(3)(d) and (h). Occupational health services. Occupational safety and health conditions in micro-enterprises, small and medium-sized enterprises and the informal economy. With reference to its previous comment, the Committee takes due note of the Government’s indications concerning the establishment of annual programmes to support and assist small and medium-sized enterprises in the prevention of occupational risks. The Committee notes that, according to the Government, it is planned to provide support for 200 enterprises in 2024. The Committee requests the Government to continue providing information on support mechanisms for a progressive improvement of OSH conditions in micro-enterprises and small and medium-sized enterprises, including any measures adopted or envisaged to broaden the coverage of occupational health services in these enterprises. It also requests the Government to provide information on any support mechanism for the progressive improvement of OSH conditions in the informal economy.
Article 5. National OSH Programme. The Committee notes the activities undertaken within the framework of the National OSH Programme 2020-24, including the awareness-raising activities organized and the development of a triennial communication plan on OSH 2022-24. The Committee also notes that, according to the Government, the steering committee responsible for the follow-up and evaluation of the National OSH Programme for the period 2020 to 2024 has not yet been established. The Committee requests the Government to indicate the measures adopted or envisaged for the evaluation and periodic review of the National OSH Programme. The Committee also requests the Government to provide information on the consultations held with the most representative employers’ and workers’ organizations in this regard.
The Committee also recalls its pending comments on the ratified technical OSH Conventions (the White Lead (Painting) Convention, 1921 (No.13), the Guarding of Machinery Convention, 1963 (No. 119), the Benzene Convention, 1971 (No. 136), the Asbestos Convention, 1986 (No. 162), and the Safety and Health in Mines Convention, 1995 (No. 176)), which were adopted by the Committee in 2022 and to which the Government will be requested to reply in 2027, in accordance with the reporting cycle.
