Article 5 of the Convention. Effective tripartite consultations. The Government’s report refers to the establishment of the National Committee for Collective Concertation, Consultation and Bargaining (CNCCNC), instituted by Decree No. 2021-338 of 7 July 2021, issuing the mandate, organization and functioning of the CNCCNC. Pursuant to this Decree, the CNCCNC is a tripartite body whose mission is to prevent social disputes, propose measures to maintain harmony, issue views and formulate proposals on international labour standards and regulations, and intervene in this regard. The Government indicates that in 2022, the CNCCNC held two working sessions and in 2023 it held three. The Government also indicates that it systematically consults the representative employers’ and workers’ organizations on subjects such as the reports concerning the application of ratified and unratified Conventions; participation in the International Labour Conference; and the processes for the ratification and promotion of the international labour Conventions. The Committee notes this information and recalls that in its direct request of 2023 on the submission of the instruments adopted by the International Labour Conference to the competent national authorities, the Committee commended the efforts made by the Government in fully meeting its constitutional obligation of submission. Noting nonetheless that the Government’s report does not provide information on the content of the consultations held in the CNCCNC since it was established in 2021, the Committee asks the Government to provide the necessary details in this regard, specifying in its next report the content and outcome of the tripartite consultations held on each of the points relating to international labour standards listed in Article 5(1) of the Convention, namely: (i) replies to questionnaires concerning items on the agenda of the Conference (Article 5(1)(a)); (ii) the submission of instruments adopted by the Conference (Article 5(1)(b)); (iii) the re-examination at appropriate intervals of unratified Conventions and of Recommendations to which effect has not yet been given (Article 5(1)(c)); (iv) the reports to be made on the application of ratified Conventions (Article 5(1)(d)); and (v) potential denunciations of ratified Conventions (Article 5(1)(e)). The Committee also notes the request for technical assistance from the Government to the Office, concerning capacity-building for the tripartite constituents and the consolidation of the national tripartite procedures and mechanisms, and hopes that this assistance will be provided shortly.
