Articles 1 and 2 of the Convention. List of recognized occupational diseases. The Committee notes the Government’s indication in its report that it has adopted Regulation No. 004/CM/CIPRES of 1 June 2018 implementing the harmonized reference scale for compensation in the aftermath of occupational accidents and diseases in the area covered by the Inter-African Conference on Social Insurance (CIPRES). The Government adds that it is in the process of adopting a national list of occupational diseases.
Recalling that it has been raising this issue for over ten years, the Committee notes with deep concern that the list of occupational diseases set forth in section 91 of the Social Security Code of 2006 and section 81 of Decree No. 09-116 of 27 April 2009, on the application of the Social Security Code, has still not been adopted. The Committee therefore urges the Government to ensure that the list of occupational diseases is adopted in the national legislation without delay, giving due consideration to the Schedule annexed to the Convention. In this regard, the Committee once again draws the Government’s attention to the List of Occupational Diseases Recommendation, 2002 (No. 194), which contains the most up-to-date list of occupational diseases at the international level.
Recommendations of the Standards Review Mechanism (SRM). The Committee recalls that the ILO Governing Body, at its 346th Session (October–November 2022), on the recommendation of the SRM Tripartite Working Group, confirmed the classification of Convention No. 18 in the category of outdated instruments, and placed an item concerning its possible abrogation or withdrawal on the agenda of the 121st Session (2033) of the International Labour Conference.
The Governing Body requested the Office to take follow-up action to actively encourage ratification of the up-to-date social security instruments, namely the Employment Injury Benefits Convention, 1964 [Schedule I amended in 1980] (No. 121), and/or the Social Security (Minimum Standards) Convention, 1952 (No. 102), and acceptance of the obligations in Part VI thereof. The Committee encourages the Government to give due consideration to the ratification of the most up-to-date instruments in this subject area.
