In order to provide a comprehensive view of the issues relating to the application of ratified Conventions on equality, the Committee considers it appropriate to examine the Conventions Nos 100 (equal remuneration) and 111 (discrimination in employment and occupation) together.

Convention No. 111 – National policy to promote equality of opportunity and treatment in respect of employment and occupation

Articles 1(1)(a), 2 and 3(b). Legislation. Further to its previous comments, the Committee notes that the Government has confirmed that section 9 of Ordinance No. 006/PR/84 of 1984 has been repealed.
Articles 1 to 3. National policy on equality of opportunity and treatment in employment and occupation. Persons with disabilities. The Committee notes the information provided by the Government on the provisions of the draft Labour Code concerning employment of persons with disabilities (affirmative action measures, including the establishment of quotas).
HIV status. The Committee notes the information provided by the Government on the provisions of the draft Labour Code concerning the employment of persons living with HIV/AIDS (protection against dismissal, prohibition of mandatory screening).

Convention No. 100 – Principle of equal remuneration for men and women for work of equal value

Articles 1 to 4. Gender pay gap. The Committee notes the lack of updated data on the employment of men and women, disaggregated by sex, economic sector and occupation, including the public sector, and on their respective earnings. It requests the Government to provide information on the measures taken to collect those data and to evaluate the gender pay gap.
Enforcement. Further to its previous comments, the Committee notes the Government’s indication that the lack of human, technical and financial resources of the labour inspection services does not allow for regular and effective inspections of issues relating to discrimination. In this regard, the Committee refers to its detailed comments under the Labour Inspection Convention, 1947 (No. 81).
