Application of the Convention in the private sector

Article 4 of the Convention. Collective bargaining in practice. The Committee takes note of the general information provided by the Government on measures taken to promote free and voluntary collective bargaining in the private sector. The Committee requests the Government to continue providing information on measures taken to promote free and voluntary collective bargaining in the private sector and to indicate the number of collective agreements signed and in force in the country, the sectors concerned and the approximate number of workers covered.

Act on trade union organization in the public service ( Act No. 18/2014)

Legislative matters. For several years, the Committee has been raising the following matters with the Government:
  • Adequate protection against anti-union discrimination and interference. The Committee requested the Government to specify the procedures and sanctions for anti-union discrimination or interference by public employers, and to provide the legislative texts governing these measures.
  • Representativity thresholds. The Committee requested the Government to lower the high representativity thresholds for forming federations and confederations or allow provisional groupings of unions, in consultation with trade unions, to facilitate collective bargaining for public employees not engaged in the administration of the State.
  • Scope of application. The Committee requested the Government to provide information on the various institutions and bodies covered by the Act and to specify the institutions considered as indirect administration of the State.
The Committee notes the Government’s indication that Act No. 18/2014 is under review and that it will provide the relevant answers as soon as the Act is adopted.
The Committee firmly hopes that the ongoing revision process will consider its comments on the above-mentioned matters with a view to bringing them into full conformity with the Convention. The Committee requests the Government to keep it informed of the progress achieved and to provide a copy of the new Act after its adoption.
The Committee reminds the Government that it can avail itself of the technical assistance of the Office.
