Direct Request (CEACR) - adopted 1998, published 87th ILC session (1999)

See under Convention No. 92, France, as follows:

With reference to its previous comments, the Committee notes with interest the provisions of Division 215 of the Regulations appended to the Order of 23 November 1987 relating to the safety of vessels, establishing rules for accommodation on board fishing and commercial vessels, in the edition which includes the Order of 19 August 1995. It requests the Government to provide additional information on the measures which ensure the application in practice of the following provisions of the Convention: Article 6, paragraph 9 (prohibition of the use of lime wash), paragraph 10 (renewal of wall surfaces as necessary) and Article 10, paragraph 11 (the marking in some place of the room of the maximum number of persons to be accommodated in any sleeping room). It requests the Government to supply a copy of the above Regulations and the Order of 19 August 1995.

Direct Request (CEACR) - adopted 1997, published 86th ILC session (1998)

See under Convention No. 92, France, as follows:

The Committee requests the Government to provide information on the following points:

Article 3, paragraph 2(a), of the Convention. The Committee requests the Government to indicate the provisions adopted or envisaged to give effect to this provision of the Convention.

Article 6, paragraph 9. The Committee requests the Government to indicate the provisions adopted or envisaged to prohibit the use of lime wash in crew accommodation.

Article 6, paragraph 10. The Committee requests the Government to indicate the measures taken to guarantee the application of this provision.

Article 6, paragraph 11. The Committee notes that section 215-1.03, paragraphs 6 and 6.1, of the Regulations attached to the Ministerial Decree of 23 November 1987 relating to the safety of vessels does not refer to the approval of the material for and construction of decks. The Committee would be grateful if the Government would indicate the measures taken or envisaged to guarantee the application of this Article.

Article 9, paragraph 1. The Committee notes that section 215-1.06, paragraph 2, of the Regulations allows special exemptions for certain vessels with particular features. It would be grateful if the Government would indicate which vessels are covered by this provision and, where necessary, the number of authorizations granted in the past few years.

Article 10, paragraph 10, and Article 13, paragraph 6. The Committee notes that section 215-1.07, paragraph 6, of the Regulations does not provide for consultation with the organizations of shipowners and/or the shipowners and the bona fide trade unions of seafarers. The Committee requests the Government to indicate the measures taken or envisaged to ensure consultation with and/or the participation of organizations of shipowners and/or the shipowners and the bona fide trade unions of seafarers with a view to the application of these Articles of the Convention.

Article 10, paragraph 11. The Committee notes that section 215-l.08, paragraph 6, of the Regulations only applies this article to vessels with a gross weight of under 500 tons. The Committee requests the Government to indicate the measures envisaged with a view to applying this provision also to vessels of over 500 tons.

Article 11, paragraph 3(c)(ii). The Committee notes that section 215-1.09, paragraph 1.2, of the Regulations, which provides for a single mess room for deck and engine department petty officers and other ratings, does not refer to the participation of shipowners and/or the organizations concerned, and the bona fide seafarers' organizations concerned. The Committee requests the Government to indicate the measures taken or envisaged to guarantee the application of this Article.

Article 14, paragraph 7. The Committee observes that in the technical regulations attached to the Order of 1 September 1971, a chapter devoted to medical service includes provisions on the approval of medical and pharmaceutical equipment. The Committee requests the Government to indicate whether such provisions are also contained in the technical regulations attached to the Order of 23 November 1987 and, if so, to send a copy of these provisions to the Office.

Direct Request (CEACR) - adopted 1994, published 81st ILC session (1994)

See under Convention No. 92, France, as follows:

The Committee notes that the Government's report contains no reply to its comments. It hopes that the next report will include full information on the matters raised in its previous direct request, which read as follows:

The Committee notes that the terms of section 55 (III) of Decree No. 84-810 of 30 August 1984 and of section 1.05 of the regulations issued in annex to the Order of 6 August 1971 empower the competent authority, in certain conditions, to accord exemptions from the provisions respecting crew accommodation. It would be grateful if the Government would indicate whether such exemptions have been accorded and, if so, provide details of them, in accordance with the requirements of the Convention.

The Committee also requests the Government to supply a copy of the full text of the regulations issued in annex to the Order of 23 November 1987, to which it refers in its report.
