Replies received to the issues raised in a direct request which do not give rise to further comments (CEACR) - adopted 2011, published 101st ILC session (2012)

The Committee notes the information provided by the Government, which answers the points raised in its previous direct request and has no further matters to raise in this regard.

Direct Request (CEACR) - adopted 2010, published 100th ILC session (2011)

The Committee notes that the Government’s report has not been received. It hopes that a report will be supplied for examination by the Committee at its next session and that it will contain full information on the matters raised in its previous direct request, which read as follows:

The Committee notes the Government’s comprehensive report. It also notes with interest that several new laws, giving effect to various provisions of the Convention have been adopted during the reporting period. In order to enable the Committee to examine the effect given to the Convention through this legislation, the Committee requests the Government to transmit copies of Decree No. 44/2000 (XII.27) EüM of the Minister of Health on the detailed rules for certain procedures and activities related to dangerous substances and dangerous preparations and Joint Decree No. 3/2002 (II. 8) SzCsM-EüM of the Minister of Social and Family Affairs and the Minister of Health on the minimum safety requirements for the workplace, with translations in English, if available.

Article 6(3). Measurement of the concentration of benzene. Please indicate whether the competent authority has issued directions on carrying out the measurement of the concentration of benzene in the air of places of employment.

1. The Committee notes the Government’s comprehensive report. It also notes with interest that several new laws, giving effect to various provisions of the Convention have been adopted during the reporting period. In order to enable the Committee to examine the effect given to the Convention through this legislation, the Committee requests the Government to transmit copies of Decree No. 44/2000 (XII.27) EüM of the Minister of Health on the detailed rules for certain procedures and activities related to dangerous substances and dangerous preparations and Joint Decree No. 3/2002 (II. 8) SzCsM-EüM of the Minister of Social and Family Affairs and the Minister of Health on the minimum safety requirements for the workplace, with translations in English, if available.

2. Article 6, paragraph 3Measurement of the concentration of benzenePlease indicate whether the competent authority has issued directions on carrying out the measurement of the concentration of benzene in the air of places of employment.

Direct Request (CEACR) - adopted 1999, published 88th ILC session (2000)

1. Articles 9 and 14(a) of the Convention. The Committee notes with interest Decree No. 27/1996 (VIII.28) NM regulating the report and investigation of occupational diseases and increased exposure. It further notes the Government's indication to the effect that its supplement 1 provides for the biological limit value of phenol and the biological exposure indicator of benzene, which is 300 mg/g creatinin in urine. The Committee invites the Government to continue to provide information in this regard.

2. Article 11. The Committee notes Decree No. 33/1998 (VI.24) NM on the medical examination and approval of suitability with regard to job category, professional standards and personal hygiene, providing for the health conditions in which women, pregnant women, minors and elderly persons (personals having already passed the pension age limit) may be employed. With regard to pregnant women and minors, the Committee recalls the provision of Article 11 of the Convention according to which women medically certified as pregnant, and nursing mothers, as well as young persons under 18 years of age shall not be employed in work processes involving exposure to benzene or products containing benzene. The Committee therefore requests the Government to indicate the provision of the abovementioned Decree which prohibits the employment of medically certified pregnant women and nursing mothers as well as young persons under the age of 18 in work processes involving exposure to benzene or products containing benzene.

3. Finally, the Committee would request the Government to supply copies of Decree No. 27/1996 (VIII.28) NM and Decree No. 33/1998 (VI.24) NM for further examination.
