Direct Request (CEACR) - adopted 2024, published 113rd ILC session (2025)

Articles 2 and 5 of the Convention. Effective tripartite consultations. The Committee welcomes the adoption of Executive Decree No. 223/22 of 19 May 2022 approving the internal rules of the National Commission for ILO Matters (CN/OIT) (hereinafter Decree No. 223/22). It notes that section 2 of the Decree does not refer among the fields of competence of the CN/OIT to: (1) the re-examination at appropriate intervals of unratified Conventions and of Recommendations to which affect has not yet been given, to consider what measures might be taken to promote their implementation and ratification (Article 5(1)(c)); or (2) proposals for the denunciation of ratified Conventions (Article 5(1)(e)). The Committee therefore requests the Government to consider amending Decree No. 223/22, referred to above, so as to include all the matters on which consultations shall be held under Article 5(1), including in subparagraphs (c) and (e). The Committee also requests the Government to ensure that information is provided on the activities of the National Commission referred to above, with an indication of the content and outcome of the tripartite consultations held in the Commission for each reporting period on the matters respecting international labour standards covered by the Convention.
Article 4(2). Financing of any necessary training. Further to its previous comment concerning the content, frequency and impact of the training provided, the Committee notes the Government’s indication that no specific agreement has been signed for the financing of training for the members of the National Commission for ILO Matters. However, the Committee notes that, under section 6(b) of Decree No. 223/22, the members of the CN/OIT have the right to benefit from training on international labour standards, where necessary. The Government specifies in this regard that its members have received training on several occasions, namely: (1) a national seminar on social dialogue for the preparation of the strategic action plan for the implementation of the national social action policy; and (2) two training courses on issues relating to the extension of the coverage of social protection and the establishment of a social protection floor (May 2021). The Committee requests the Government to continue providing updated information on the training provided to the members of the National Commission for ILO Matters so as to ensure that the persons who participate in the work of the Commission have the necessary knowledge, particularly on the scope of the obligations deriving from the Convention.
Article 6. Annual reports. The Committee notes that, under the terms of section 4(6) of Decree No. 223/22, the reports of the meetings of the CN/OIT (ordinary and extraordinary) are discussed and approved by consensus. The Committee requests the Government to provide copies of the reports of these meetings in accordance with Article 6 of the Convention.
Technical assistance. The Committee notes that the Government is requesting technical assistance with a view to: (1) reinforcing consultation mechanisms; (2) the provision of training on issues relating to social dialogue and the tripartite model; and (3) sharing good practices in relation to the application of the Convention. It hopes that the Office will be in a position to provide the technical assistance requested in the near future and that the Government will be able to provide information in its next report on the activities carried out with the support of the ILO with a view to the sound application of the Convention.

Articles 2 and 5 of the Convention. Effective tripartite consultations. The Committee welcomes the information provided by the Government in its first report on the application of the Convention. The Government reports that the most representative employers’ organizations for the purposes of the Convention are: (i) the Angolan Chamber of Commerce and Industry (CCIA); (ii) the Angolan Industrial Association (AIA); and (iii) the Federation of Angolan Women Entrepreneurs (FMEA). In turn, the most representative workers’ organizations are: (i) the National Union of Angolan Workers – Trade Union Confederation (UNTA–CS); (ii) the General Federation of Independent and Free Trade Unions of Angola (CGSILA); and (iii) the Angolan Trade Union Force – Confederation of Trade Unions (FSA-CS). The Committee notes with interest that effective tripartite consultations with respect to the matters concerning international labour standards set out in Article 5(1) of the Convention are ensured through a committee constituted specifically to examine these matters: the National Committee for ILO Affairs. The Committee requests the Government to continue to provide updated information on the content, frequency and outcome of the tripartite consultations held on international labour standards pursuant to Article 5(1)(a) through (e) of the Convention.
Article 4(2). Financing of necessary training. The Committee notes that the Government has not provided information with respect to any arrangements made to ensure the financing of any necessary training of the members of the National Committee for ILO Affairs. The Committee requests the Government to provide updated information on whether such trainings are held, and if so, to provide information regarding their content, frequency and impact.
