The Committee notes the observations of the Uzbekistan Trade Union Federation (UTUF), received on 27 September 2022. It asks the Government to communicate its response in this respect.
Articles 2 and 5 of the Convention.Effective tripartite consultations. The Committee notes the information provided by the Government on the tripartite consultations held within the National Tripartite Commission on Social and Labour Issue (National Tripartite Commission). In 2022, tripartite consultations were held by poll on the possibility of ratifying Conventions Nos 95, 121, 131, 132, 148, 155, 167, 177, 183, 184, and 190. In this regard, the Committee notes with interest the ratification of Convention No. 95 on 17 April 2024, Convention No. 148 on 12 June 2023, and Convention No. 167 on 9 June 2022. The Government indicates that the National Tripartite Commission also considered the feasibility of ratifying No.155 and submitted proposals to the Cabinet of Ministers for its consideration. Moreover, on 29 March 2023, ILO experts presented the results of a gap analysis on Convention No. 190 and its ratification is currently being examined. The Committee notes this information and requests the Government to provide with its next report detailed information on the content and the outcome of the tripartite consultations held on all of the international labour standards related matters covered by Article 5(1), items (a) through (e), of the Convention. It also requests the Government to continue providing updated information on any developments regarding the ratification of the abovementioned Conventions, particularly Conventions Nos 155 and 190.
Article 3(1). Freely chosen representatives.Noting that the Government has not provided the information requested, the Committee once again requests the Government to provide information on the procedures adopted to select the representatives of each party.
Article 3(2). Equal representation.Noting that the Government has not provided the information requested, the Committee once again requests the Government to provide information regarding the manner in which the principle of equal representation among the tripartite groups is given effect.
Article 4(1). Administrative support. The Committee notes the information submitted by the Government on the composition and functioning of the Secretariat of the National Tripartite Commission. The Committee observes, however, that the Government does not provide information how the consultative procedures are funded. The Committee invites the Government to provide in its next report detailed information on the manner in which it intends to assume responsibility for the administrative support of the consultation procedures covered by the Convention (Article 4(1)).
Article 4(2). Financing of necessary training. The Government indicates that the financing of any necessary training of participants on the consultative procedures is a matter for the parties to decide by mutual agreement. The Committee observes, however, that the Government does not provide information on trainings held. The Committee recalls that the Convention places on the Government the responsibility for the functioning of the administrative procedures, which encapsulates the responsibility to make the appropriate arrangements for the financing of the necessary training of the participants in these procedures. Noting that the Government has not provided the specific information requested, the Committee reiterates its requests to the Government to provide updated information in its next report in relation to this issue.
Article 6. Annual report. The Committee notes the Government’s indication that, in accordance with the Cabinet of Ministers Decision No. 553 of 3 July 2019, the main tasks of the National Tripartite Commission include the yearly publication of reports on the implementation of the tripartite procedures provided for in the Convention. In this respect, the Committee welcomes the annual report “The practice of conducting tripartite social dialogue in Uzbekistan with emphasis on the activities of the Tripartite Commission on Social and Labour Affairs” of the Ministry of Employment, which was endorsed by the tripartite partners. The Committee requests the Government to provide a copy of the annual report in its next report.
