Labour Inspection Convention, 1947 (No. 81) - Grenada (Ratification: 1979)

Legislation. The Committee notes the Government’s indication that the Occupational Health and Safety Bill is on the legislative agenda for 2025. The Committee also notes that, according to the information provided by the ILO Decent Work Country Office in the Caribbean, the Employment bill is being treated together with the Employment Relations bill, and it is expected to be passed in the first half of 2025. The Committee requests the Government to continue to pursue its efforts in the adoption of these legislative changes and to provide information on the progress made in this regard.
Articles 3(1)(a) and (b) and 13 of the Convention. Preventive and enforcement action by labour officers in the field of occupational safety and health. In reply to the Committee’s previous request, the Government indicates that: (i) in cases of non-compliance with safety standards, labour officers give a verbal warning and a deadline to address and remedy the matter; (ii) after the deadline, a second inspection will be performed; (iii) in the reporting period, all businesses complied with the inspection orders and made the necessary adjustments to ensure compliance; and (iv) labour inspectors have not taken any measures with immediate executory force in case of imminent danger for the period under review as there was no situation which warranted such action. The Committee requests the Government to continue to provide information on the measures adopted by labour inspectors in cases when they had reasonable cause to believe that defects in workplaces constituted athreat to the health or safety of workers (Article 13(1)) and on preventive measures adopted with immediate executory force in the event of imminent danger to the health or safety of workers (Article 13(2)).
Article 7(3). Training of labour inspectors. In reply to the Committee’s previous request the Government indicates that all labour inspectors, at the time of appointment, undergo training under the supervision of the senior labour officers within the first year on the job. Thereafter, training is done as the need arises. Labour officers are also trained to use devices such as air quality metres. The Committee takes note of this information, which addresses its previous request.
Articles 20 and 21. Establishment, publication and communication to the ILO of annual inspection reports. In reply to the Committee’s previous request, the Government indicates that the Department of Labour has recently implemented a database system to maintain records of inspections, penalties and corrective and preventive actions taken. This system will simplify the process of compiling, accessing, and assessing the information related to inspections. The Government envisages that this system will enable the Department of Labour to publish and transmit timely and comprehensive annual inspection reports in the future. The Government also provides information on the number of labour inspectors and the number of labour inspections conducted between 2021 and 2023. The Committee requests the Government to continue to pursue its efforts to ensure the preparation, publication and transmission to the ILO of the annual labour inspection report. The Committee also requests the Government to ensure that the report contains all the information listed in Article 21 of the Convention.
