Article 8 of the Convention. Deductions from wages. Limits. Further to its previous comments, the Committee notes that the Government’s report does not contain any relevant information related to its request to indicate how the expression ‘deduction-free part’ of the wages in section 161(2)(a) of the Labour Law is legally defined. The Committee recalls that Article 8(1) of the Convention provides that deductions from wages shall be permitted only under conditions and to the extent prescribed by national laws or regulations or fixed by collective agreement or arbitration award. The Committee once again requests the Government to indicate how the “deduction-free part” of the wages referred to in section 161(2) of the Labour Code is legally defined. It also requests the Government to indicate how it is ensured in law and in practice that the amount of wages left after deductions under Section 161(2) is sufficient to ensure the maintenance of workers and their families. It further requests the Government to indicate the measures taken or envisaged to establish a maximum limit to the amounts that may be deducted from workers’ wages in application of section 161(2) of the Labour Code.
