Article 5(1) of the Convention. Effective tripartite consultations. The Committee welcomes the ratification of the Violence and Harassment Convention, 2019 (No. 190), following consultations within the National Labour Council (NLC) in June 2020. It also notes with interest the adoption of the Decent Work Country Programme (DWCP) for 2023–26, concluded in January 2023, a priority of which is the improvement of social dialogue through the promotion of appropriate and effective forums. In particular, the Committee notes the indication by the Government and the Union of Independent Trade Unions of Albania (BSPSH) that the NLC was re-established and reorganized in May 2022 (Decision of the Council of Ministers (DCM) No. 356 of 26 May 2022 on the appointment of employers’ and workers’ organizations to the NLC; Order of the Minister of Finance and the Economy No. 186 of 4 July 2022 on the appointment of members and candidates of the NLC, representatives of employers’ and workers’ organizations).
In addition, according to the report, as part of the reorganization of the NLC, six specialized standing tripartite committees have been established (DCM No. 265 of 27 April 2023), and the rules of procedure of the NLC will be revised to improve the consultation process at national level. The Committee notes that, since the NLC was re-established, it has met twice, in 2022 and once in 2023. The Committee notes from the agendas of these three meetings provided by the Government that the consultations carried out did not address any of the points listed in Article 5(1) of the Convention on which the Convention requires effective consultations to be held with representatives of employers and workers. The Committee therefore considers that it is not in a position to assess the extent to which effect is given to the Convention and once again requests the Government to provide detailed and updated information on the content and outcome of the tripartite consultations held on all matters concerning international labour standards covered by Article 5(1) of the Convention. It also requests the Government to provide further information on the specialized standing tripartite committees established in 2023, indicating in particular whether the nature of their work falls within the scope of the consultations required by subparagraphs (a) to (e) of Article 5(1) of the Convention.
Article 4(2). Training. The Committee requests the Government to provide information on the manner in which the administrative support of the procedures provided for in the Convention is organized, indicating in particular how the financing of any necessary training of participants in these procedures is ensured, especially of newly appointed members of the National Labour Council, so that they can assume their role in an appropriate manner.
