Direct Request (CEACR) - adopted 2025, published 114th ILC session (2026)

Article 4. Equality of opportunity and treatment. Positive measures. The Committee has previously requested the Government to provide information on positive measures taken to ensure equal access to education and training for persons with disabilities, as well as to ensure their right to earn a living through work of their choosing. The Government indicates that the “Inclusive Technical and Vocational Education and Training Project (AFKAR 3)”, launched in 2015, has produced several recent studies, developed a new information system for education and vocational rehabilitation, and created a specialized training guide for integrating teams with educational institutes and their teachers. The Project has addressed stakeholder needs and introduced greater diversity to vocational training, including training in small enterprise management. The Government adds that this initiative is recognized as a significant transformative process that promotes a model of inclusion founded on the importance of self-employment as a valuable experience. Furthermore, the Project has collaborated with credit institutions to develop special measures for persons with disabilities and has worked on the draft five-year strategic plan for inclusive vocational rehabilitation in Lebanon. The Committee notes the Government’s indication that these transitional achievements faced challenges, such as prejudice, resistance from some institutes concerned about additional workloads, and inadequate accessibility. Referring to Paragraph 11 of the Vocational Rehabilitation and Employment (Disabled Persons) Recommendation, 1983 (No. 168), which provides guidance for establishing positive measures, the Committee requests the Government to provide more detailed information on the impact of the positive measures adopted to ensure equal access to education and training for persons with disabilities, as well as to ensure their right to earn a living through work of their choosing. It also requests the Government to provide information on the impact of the Inclusive Technical and Vocational Education and Training Project’s implementation.
Article 5. Consultation with the social partners and with organizations of and for persons with disabilities. The Committee notes a 2023 position paper that was prepared and endorsed by a group of eight organizations of persons with disabilities, under the framework of a collaboration with the ILO “Towards Inclusive Social Protection in Lebanon”. It notes from the paper that, while many stakeholders claim to engage and consult persons with disabilities, laws, policies and programmes are often adopted without consulting organizations representing persons with disabilities. The Committee therefore requests the Government to provide information on the content and outcome of the consultations held with the social partners and organizations of and for persons with disabilities on the matters covered by the Convention.
Article 7. Services accessible to persons with disabilities. The Government indicates that there is a very low percentage of civil service employees with disabilities. In the private sector, employers must apply to the National Employment Office to hire persons with disabilities. The Committee noes that, in April 2023, the Ministry of Social Affairs, in partnership with the European Union, UNICEF and the ILO, launched the National Disability Allowance (NDA) programme, providing direct income support to persons with disabilities. The NDA was designed to strengthen the existing national programmes and services for persons with disabilities, helping to cover extra disability costs and access essential services. Initially targeting youth aged 18 to 28, the programme offers a monthly US$40 allowance to at least 20,000 individuals during an initial period of 12 months. The Committee requests the Government to provide updated information on the implementation of the National Disability Allowance programme. It also once again requests the Government to provide information, including statistical data, on the measures implemented by the private and the public sectors to enable persons with disabilities to secure, retain and advance in employment.
Article 9. Suitably trained and qualified staff. The Committee previously noted the Government’s indication that the Department of Disability Affairs within the Ministry of Social Affairs and the Persons with Disabilities Department at the National Employment Office are staffed by competent and experienced personnel, but that these departments lack the necessary financial resources due to the situation of Lebanon and the surrounding region. The Government reports that the National Employment Office operates under difficult conditions, with information technology devices and equipment frequently inoperative due to power outages. This has undermined the Office’s ability to process employment applications from jobseekers, store information, and communicate with private sector employers to identify job opportunities. As a result, the Office’s capacity to support and finance vocational training projects and workshops for persons with disabilities has also been negatively impacted. Despite these challenges, the Government indicates that the Department of Disability Affairs continues to provide vocational training in collaboration with specialized institutions and is assessing the experiences and qualifications gained by individual with disabilities who utilized these services. While acknowledging the difficult circumstances in the country, the Committee requests the Government to provide updated information on the availability of qualified vocational rehabilitation staff for the vocational guidance, vocational training and placement and employment of persons with disabilities. It also requests the Government to provide information on measures taken to ensure the effective delivery of these services to persons with disabilities.

Observation (CEACR) - adopted 2025, published 114th ILC session (2026)

The Committee notes the observations of the General Confederation of Lebanese Workers (CGTL), communicated with the Government’s report. The Committee requests the Government to provide its comments on these observations.
Articles 2 and 3 of the Convention. National policy on vocational rehabilitation and employment of persons with disabilities. The Committee refers to its previous comments and recalls that sections 73 and 74 of Act No. 220 of 29 May 2000 mandate that three per cent of jobs be reserved for persons with disabilities in both the public and private sectors (for enterprises that employ more than 60 workers). It also recalls that a draft decree intended to implement section 74 of Act No. 220/2000 was forwarded to the Council of Ministers for promulgation. The Government indicates that Decision No. 96/1, dated 25 November 2021, pertains to businesses, occupations and crafts, and jobs that must be exclusively reserved for Lebanese nationals. This Decision contains provisions aimed at implementing Act. No. 220/2000 within the framework of respecting human rights, including the right to employment and the opportunity to utilize one’s talents and skills. In its observations, the CGTL indicates that Lebanese legislation and international Conventions contain numerous provisions requiring the Government to uphold the rights of individuals with disabilities. The CGTL adds, however, that section 74 of Act No. 220/2000 mandating employers to employ persons with disabilities has gone unimplemented, with neither hiring targets nor penalties for non-compliance effectively enforced. The Committee notes the Government’s indication that a committee was established to implement the right to work, in accordance with Act No. 220/2000, and has proposed a draft decree on unemployment allowances and the activation of employment opportunities for persons with disabilities in the private sector. Additionally, the Committee notes from the January 2020 data provided by the Government that out of the 59,951 persons with disabilities aged between 18 and 64 (holding an identification card from the Ministry of Social Affairs) 19.95 per cent are employed (with employment rates of 26.78 per cent for men and 7.28 per cent for women). It also notes from a 2023 ILO publication that formal employment for Lebanese persons with a disability is less likely than it is for those with no disability. Significantly more Lebanese persons with a disability were informally employed (63.8 per cent) compared to those with no disability (43.4 per cent). The Committee notes with concern that, despite the adoption of Act No. 220 of 29 May 2000, more than two decades have passed without its full and effective implementation, particularly the enforcement of section 74 on the employment quota for persons with disabilities. The Committee recalls that such prolonged inaction constitutes a serious and continuing obstacle to the realization of the right of persons with disabilities to vocational rehabilitation and employment on an equal basis with others, as guaranteed under Articles 2 and 3 of the Convention. It therefore urges the Government to take without further delay all necessary legislative, administrative, and practical measures to give full effect to Act No. 220/2000, including the promulgation of the implementation decree and the establishment of clear enforcement mechanisms and sanctions for non-compliance. The Committee requests the Government to provide, in its next report, comprehensive and up-to-date information on the concrete steps taken to operationalize the quota system, on measures to promote inclusion in the open labour market, and on the progress achieved in improving the employment rate of persons with disabilities in both the public and private sectors.
The Committee is raising other issues in a request addressed directly to the Government.

The Committee notes the Government’s report received in October 2009 in reply to the 2004 direct request. The Government indicates that the Committee for the Promotion of the Rights at Work of Persons with Disabilities has prepared a draft study entitled “Measures to enable each person with disabilities to exercise a liberal profession or self-employment”. The study is intended to help persons with disabilities to establish and manage micro activities in production and services which are economically feasible and which therefore guarantee them work opportunities, financial independence, a decent living standard and improved vocational integration. The Government reports the adoption of Decision No. 45-2006 of 26 May 2006 establishing a commission to prepare a draft decree to give effect to section 74 of Act No. 220 of 29 May 2000, which provides that a certain percentage of jobs shall be reserved for persons with disabilities in the private sector. A draft decree to give effect to section 74 of Act No. 220 of 29 May 2000 has been prepared and forwarded to the Council of Ministers. The Committee invites the Government to indicate whether the study and the Decree referred to above have been implemented and the results of their application in terms of promoting the employment of persons with disabilities. It requests the Government to provide specific practical information, such as statistical data, extracts from reports, studies or surveys on matters covered by the Convention.
Article 4. Equality of opportunity and treatment. The Government indicates that the commission responsible for the study and the follow-up of international labour Conventions has engaged in dialogue with the competent authorities responsible for recruitment in the public service with a view to confirming the provisions and principles contained in Act No. 220 of 29 May 2000. The Government adds that the Ministry of Labour pays specific attention to the rights at work of persons with disabilities and that, accordingly, it is requesting ILO technical assistance with a view to taking additional measures for the achievement of effective equality of opportunity and treatment between workers with disabilities and workers generally. The Committee invites the Government to provide additional information on the special affirmative measures adopted to guarantee effective equality of opportunity and treatment between workers with disabilities and other workers, as well as detailed statistical data on the employment of persons with disabilities.
Article 7. Services accessible to persons with disabilities. The Government refers in its report to the work of the Committee for the Promotion of the Rights at Work of Persons with Disabilities. The Government adds that the Ministry of Social Affairs is also authorized to receive complaints made by persons with disabilities encountering difficulties in their work. It helps them with vocational guidance in coordination with public and private sector enterprises and participates in the meetings of the Committee for the Promotion of the Rights at Work of Persons with Disabilities. The Committee notes the conditions of entitlement required for granting loans and the financing institutions through which applications for loans may be made. Moreover, associations and banks have granted loans under favourable conditions to persons with disabilities to enable them to start up projects. The Committee invites the Government to provide additional information on the various vocational guidance, vocational training, placement, employment and other related services intended to enable persons with disabilities to secure, retain and advance in employment.
Article 9. Suitably qualified staff. The Committee notes that the Government has requested ILO technical assistance to give effect to the provisions of Article 9 of the Convention. It invites the Government to provide information on the progress achieved in giving effect to the provisions of Article 9 of the Convention.

Direct Request (CEACR) - adopted 2004, published 93rd ILC session (2005)

1. The Committee notes with interest the detailed information provided by the Government in its first report on the application of the Convention as well as the additional information received in September 2004. It notes in particular that Act No. 220 of 29 May 2000 provides for incentives and dissuasive measures to promote employment opportunities in the open labour market and that a percentage of jobs are reserved for persons with disabilities. In this respect, the Government states that, in a note of 12 August 2002, the Director-General of the Ministry of Labour invites the labour inspectors to ask employers to apply the provisions in the abovementioned Act. Noting the establishment in April 2004 of a committee to implement the rights of disabled persons at work, the Committee would be grateful if the Government would provide information on the practical implementation of the measures provided for in Act No. 220 of 2000. Please also provide information on the manner in which the national policy is periodically reviewed, on the activities of the Committee on the Promotion of the Rights of Disabled Persons at Work and on the results of the measures taken to promote employment opportunities for persons with disabilities in the open labour market (Articles 2 and 3 of the Convention).

2. Article 4. Please provide information on the impact of the measures aimed at effective equality of opportunity and treatment between workers with disabilities and other workers.

3. Article 7. The Committee notes the establishment of an ad hoc committee for the training of disabled persons pursuant to Ministerial Council Decision No. 20 of 15 January 2004. The Government also refers to Ministerial Council Decision No. 50 of 3 December 2004 approving a planned study of mechanisms which would allow all disabled persons to carry out a liberal profession or an independent work. Noting that the Government has requested assistance from the Office to set up such mechanisms, the Committee asks the Government to keep it informed on the progress made in this respect. Please also provide detailed information on the various services available in practice to secure, retain and advance persons with disabilities in employment.

4. Article 9. Please indicate any measures taken to put into practice the system of staff suitably qualified in vocational rehabilitation of disabled persons, as described in the report.
