Observation (CEACR) - adopted 2025, published 114th ILC session (2026)

Submission. Date of submission. Consultation. The Committee notes with interest the ratification of the Violence and Harassment Convention, 2019 (No. 190), on 13 December 2024. The Committee notes, however, that the Government has not provided information in response to its previous comments. It therefore recalls the information provided by the Government to the Conference in June 2023, indicating that it had begun the process of ratification and submission of the ten instruments adopted by the Conference at its 99th, 100th, 101st, 103rd, 104th, 106th and 108th Sessions. The Government reported that the 2014 Protocol to the Forced Labour Convention, 1930, the Domestic Workers Convention, 2011 (No. 189), the Violence and Harassment Convention (No. 190) and its Recommendation (No. 206), 2019, had been reviewed by the Tripartite Consultative Labour Council (TCLC), which recommended their ratification. The Government also informed that the HIV and AIDS Recommendation, 2010 (No. 200), the Social Protection Floors Recommendation, 2012 (No. 202), the Transition from the Informal to the Formal Economy Recommendation, 2015 (No. 204), and the Employment and Decent Work for Peace and Resilience Recommendation, 2017 (No. 205), were in the process of being submitted to Cabinet for information.
Moreover, the Committee notes that the Government once again does not provide information regarding the submission of: (i) the Forced Labour (Supplementary Measures) Recommendation, 2014 (No. 203), and the Domestic Workers Recommendation, 2011 (No. 201); (ii) the date of submission to the National Assembly of the 12 instruments adopted by the Conference from 1996 to 2007. The Committee recalls once more that the constitutional obligation of submission is of the highest importance and is a fundamental element of the standards system of the ILO. Therefore, the Committee once more reiterates its request that the Government indicate the dates on which the 12 instruments adopted by the Conference from 1996 to 2007 were submitted to the National Assembly. It also once again reiterates its request that the Government provide information on any action taken by the National Assembly in relation to these submissions, as well as with respect to the prior tripartite consultations that took place with the social partners. In addition, the Committee reiterates its request that the Government provide information on the submission to the National Assembly of the 13 instruments (Conventions, Recommendations and the Protocol) adopted by the Conference at its 99th, 100th, 101st, 103rd, 104th, 106th, 108th and 111th Sessions (2010–23). The Committee expresses the hope that the Government will provide the information requested without further delay.
The Committee once again recalls that the Government may request the technical assistance of the Office, if it so wishes, to assist it in achieving compliance with its obligations under article 19 of the Constitution with respect to the submission to the competent authorities of the instruments adopted by the Conference.
