Repetition The Committee notes the Government’s detailed first report submitted in 2007 including the attached legislation, and the second report submitted in 2009. Having examined the reports and information provided, the Committee would like to draw to the Government’s attention that the present Convention is intended to serve a specific purpose, namely to prevent the occurrence of major industrial accidents, as defined in the Convention, and to ensure that all relevant preventive measures are taken to limit the impact of such accidents on workers, the public and the environment. The Committee notes that the information provided by the Government appears to relate more generally to the management of polluting industries and the efforts to limit their environmental impact and do not, specifically, address the requirements of the Articles in the Convention. This is the case, in particular, as regards the information provided concerning the application of Articles 1, 4, 5, 7, 9, 15–19. The Committee also notes that the reports provided by the Government are silent as regards the application of Articles 3, 10–12 and that the Government indicates that measures to give effect to Articles 8, 13–14 will be undertaken by the Higher National Council for Occupational Safety and Health which is being established. The Committee also notes that the information provided by the Government regarding the application of Articles 20–22 of the Convention relate more generally to the rights and duties of workers, and their representatives, in the management of their work and not to the specific rights and duties regulated in these Articles of the Convention. Against this background the Committee requests the Government to undertake a comprehensive review of its application of the Convention in consultation with the most representative organizations of employers and workers with the purpose of formulating, implementing and periodically reviewing a coherent national policy concerning the protection of workers, the public and the environment against the risk of major accidents and to ensure a full application of the Convention. The Committee also reminds the Government of the possibility to seek technical assistance from the Office to assist it in this process. Part IV of the report form. Application in practice. The Committee also asks the Government to give a general appreciation of the manner in which the Convention is applied in the country, to the extent that such information would be available, and to attach extracts from inspection reports and, where such statistics exist, the number and nature of the contraventions reported; the number, nature of infringements reported, etc.
