Articles 2 and 5 of the Convention. Effective tripartite consultations. The Committee notes the Government’s indication that, since it took office in 2022, efforts have been made to improve the consultations provided for in the Convention. The reports to be submitted under article 22 of the ILO Constitution are sent to the representative organizations earlier than in previous years to allow them to make observations more easily (Article 5(1)(d)). The Government adds, with regard to the submission of ILO instruments, that consultations have been extended to other trade union organizations and confederations. In this regard, the Committee notes that three instruments were ratified between 2021 and 2024, namely, the Safety and Health in Mines Convention, 1995 (No. 176), the Violence and Harassment Convention, 2019 (No. 190), and the Protocol of 2014 to the Forced Labour Convention, 1930. It recalls that 25 instruments have yet to be submitted to the competent authority (Article 5(1)(b)). The Committee further notes that the Higher Labour Council held nine meetings in 2022, six in 2023 and four between January and July 2024. The subcommittee responsible for mining issues has also been set up. Lastly, the Committee notes that the Government does not provide information on the tripartite consultations held on the replies to questionnaires concerning items on the agenda of the International Labour Conference; the re-examination at appropriate intervals of unratified Conventions and of Recommendations; and proposals for the denunciation of ratified Conventions (Article 5(1)(a), (c) and (e)). The Committee requests the Government to continue to provide detailed and up-to-date information on the specific content, frequency and outcome of the tripartite consultations held on all matters relating to the international labour standards covered by Article 5(1) of the Convention, and in particular those covered by Article 5(1)(a), (c) and (e).
The Committee also notes the information provided by the Government in response to the observations made in 2018 and 2020 by the Single Central Organization of Workers of Chile (CUT-Chile).
