In order to provide an overview of all the issues relating to the application of the ratified Conventions on the medical examination of young persons, the Committee considers it appropriate to examine Conventions Nos 77 and 78 together.
The Committee notes the observations of the Workers Confederation of Comoros (CTTC), received on 26 July 2025. It requests the Government to provide its comments in this regard.
Article 6 of Conventions Nos 77 and 78. Vocational guidance and physical and vocational rehabilitation of children and young persons found to be unsuited to certain types of work. The Committee notes the Government’s indication, in its report, reiterating its willingness to take specific measures aimed at regulating vocational guidance and physical and vocational rehabilitation of children and young persons found by medical examination to be unsuited to certain types of work, in accordance with Article 6 of the Conventions.
The Committee notes with concern, however, that the law still does not contain any provisions for the vocational guidance and physical and vocational rehabilitation of children and young persons found by medical examination to be unsuited to certain types of work or to have physical disabilities or limitations. It recalls that Article 6 of the Conventions requires that appropriate measures be taken by the competent authority for vocational guidance and physical and vocational rehabilitation of children and young persons found by medical examination to be unsuited to certain types of work or to have physical handicaps or limitations. The Committee urges the Government to take specific measures for the vocational guidance and physical and vocational rehabilitation of children and young persons found by medical examination to be unsuited to certain types of work or to have physical disabilities or limitations, in accordance with Article 6. It requests the Government to provide information on the progress achieved in this regard.
Article 7(2) of Convention No. 78. Scope of application and supervision of the application of the system of medical examination for fitness for employment to young persons engaged either on their own account or on account of their parents.The Committee notes the absence of information provided by the Government on this subject and, therefore, once again requests the Government to take the necessary measures to establish supervision of the application of the system of medical examination for fitness for employment to young persons engaged either on their own account or on account of their parents, in itinerant trading or in any other occupation carried out in the streets or in places to which the public have access. It requests the Government to provide information on any progress achieved in this regard.
Application of the Conventions in practice. The Committee notes that the CTTC expresses its concerns at the lack of staff in labour inspection and at the absence of labour inspection in enterprises to verify that medical examinations of young workers have been properly conducted. The Committee requests the Government to provide: (i) information on the number of children and young persons who are engaged in work and have undergone pre-occupational and periodic medical examinations, as set out in the Conventions; and (ii) extracts of labour inspection reports concerning the offences reported and penalties imposed.
