Articles 3 and 4 of the Convention. Interference in the financial administration of a trade union. No dissolution or suspension of organizations by administrative authority. In its previous comments, the Committee urged the Government to take the necessary measures to amend section 33(2) of the Trade Unions Act, which allows the Registrar to demand detailed financial information from unions, and to amend certain provisions of the draft Labour Code, which, if adopted, would confer excessive powers to the Registrar, in particular as regards the powers to demand detailed financial information from unions (section N33(2)), and to withdraw or cancel registration in certain circumstances (sections N14(e) and N15). The Committee notes with regret that the Government once again reiterates that a formal request was submitted to the competent authority regarding the requested amendment to the Trade Unions Act. As concerns the draft Labour Code, while welcoming the Government’s recognition of the urgency of the matters raised by the Committee, the Committee regrets to note the Government’s indication that the codification has not been achieved yet. The Committee further notes the Government’s indication that the tripartite constituents have been tasked to work separately on various sections of the Code and that together with the Trade Union Act this matter will be submitted to the National Tripartite Committee. The Committee expects that section 33(2) of the Trade Unions Act will be amended and a new Labour Code adopted without further delay in line with the Committee’s comments and in consultation with the social partners. The Committee requests the Government to provide a copy of the legislation once adopted.
