In order to provide a comprehensive view of the issues relating to the application of the Conventions on the medical examination of young persons, the Committee considers it appropriate to examine Conventions Nos 77 and 78 in a single comment.
Article 3(2) of Conventions Nos 77 and 78. Annual repetition of the medical examination. Further to its previous comments, the Committee notes that the Government merely reiterates, in its report, the information it provided previously, namely that Resolution No. 284 of 17 June 2014 establishes the obligation of an annual medical examination for certain activities involving risks, and that this obligation applies to young persons between 15 and 18 years of age. However, the Committee once again points out that Resolution No. 284 only refers to activities involving risks, and that it does not provide for periodic medical examinations for all types of work, whether dangerous or not, for workers under the age of 18. It once again recalls that the repetition of the medical examination at intervals of not more than one year, as required by Article 3(2) of the Conventions, applies to all types of work, dangerous or not, performed by young persons under 18 years of age, and not only to work involving risks. The Committee therefore requests the Government to take the necessary steps to provide for the obligatory repetition of the medical examination for fitness to work for children or young persons at intervals of not more than one year.
