Serious failure to submit. The Committee notes the information provided by the Government on 26 September 2025, which include three Cabinet Memorandums dated 25 June 2025, 15 November 2017 and 27 August 2012. It observes that: (i) the 2012 Cabinet Memorandum called for a review of the instruments adopted by the Conference between 1996 and 2012; (ii) the 2017 Cabinet Memorandum extended this review to instruments adopted between 1996 and 2017; and (iii) the 2025 Memorandum proposes a revision of the list of instruments adopted by the Conference up to 2023. Furthermore, in the Cabinet Memorandums, it is stated that, while in most ILO Member States the competent authority is the Parliament, in Saint Kitts and Nevis the competent authority is the Cabinet.
While taking due note of the above information, the Committee wish to draw the Government’s attention to the Memorandum concerning the obligation to submit Conventions and Recommendations to the competent authorities, adopted by the Governing Body in 2005, which defines the “competent authority” as the body that, under the Constitution of each State, has the power to legislate or take other actions necessary to implement Conventions and Recommendations. Part II of the Memorandum states that the competent national authority should normally be the legislature. In this regard, the Committee recalls that over the years expressed its view that, in Saint Kitts and Nevis, the National Assembly would appear to correspond most closely to the deliberative assembly envisaged by the 2005 Memorandum and to which the instruments adopted by the Conference should be transmitted at least for information purposes. The Committee therefore once again expresses the firm hope, as did the Conference Committee in June 2017, June 2018, June 2019, June 2021, June 2022, June 2023, June 2024 and June 2025 that the Government will comply with its obligation to submit Conventions, Recommendations and Protocols to the National Assembly. The Committee urges the Government to provide information on the submission to the National Assembly of the 29 instruments adopted by the Conference at the 17 sessions held between 1996 and 2019 (83rd, 85th, 86th, 88th, 89th, 90th, 91st, 92nd, 95th, 96th, 99th, 100th, 101st, 103rd, 104th, 106th and 108th Sessions). It also reiterates its request to the Government to provide information on the submission of the Safe and Healthy Working Environment (Consequential Amendments) Convention (No. 191) and Recommendation (No. 207), 2023, and the Quality Apprenticeships Recommendation, 2023 (No. 208), adopted by the Conference at its 111th Session.
The Committee recalls once again that the Government may request the technical assistance of the Office, if it so wishes, to assist it in achieving compliance with its obligations under article 19 of the Constitution with respect to the submission to the competent authorities of the instruments adopted by the Conference.
