Convention (n° 184) sur la sécurité et la santé dans l'agriculture, 2001 - France (Ratification: 2021)

The Committee notes the Government’s first report.

Article 8(2) of the Convention. Rights and duties of workers in agriculture and their representatives. The Committee notes the provisions of section L.4122-1 of the Labour Code, which indicates that, in accordance with the instructions given by the employer, under the conditions envisaged in the internal rules in enterprises required to adopt them, it is the responsibility of each worker to take care, on the basis of their training and responsibilities, of their health and safety and that of other persons concerned by their acts or omissions at work. Recalling that the obligations provided for in Article 8(2) of the Convention, to comply with the prescribed safety and health measures and to cooperate, applies to both workers and their representatives, the Committee requests the Government to indicate if the provisions in section L4122-1 of the Labour Code also apply to workers' representatives, and if not, to provide information on the measures taken to ensure the full implementation of Article 8(2) of the Convention.

Application of the Convention in practice. The Committee requests the Government to provide information on the application of the Convention in practice, including the available statistical information on the number of occupational accidents and cases of occupational diseases in the agricultural sector, and on the inspections undertaken, infringements detected and penalties imposed.
