Article 25 of the Convention. Identification and prosecution of cases of forced labour, including trafficking in persons. With regard to its previous comments concerning the number of investigations and prosecutions carried out under section 3 of the Trafficking in Persons (Prevention) Act, 2008 in relation to cases of trafficking and other forms of forced labour, the Government indicates in its report that to date no official case of trafficking in persons has been identified through the investigating bodies. The Government indicates that it is committed to combat all forms of forced labour and trafficking in persons through social dialogue and the strengthening the legal framework.
The Committee notes that the United Nations Committee on the Elimination of All Forms of Discrimination against Women (CEDAW), in its concluding observations of 5 November 2020, noted with concern the lack of information on the incidence of trafficking, including on the number of reported cases, prosecutions and convictions of perpetrators of trafficking related offences (CEDAW/C/KNA/CO/5-9). In this regard, the Committee observes that the Trafficking in Persons (Prevention) Act, 2008 provides for the appointment of an inter-agency task force to develop and implement a National Plan for combating trafficking in persons; collect, coordinate and share information on trafficking data; coordinate and provide training for law enforcement, immigration and other relevant officials.
The Committee requests the Government to provide information on the establishment of the inter-agency taskforce and the development of a national plan for combating trafficking. The Committee also requests the Government to indicate the measures taken to strengthen the capacities of the law enforcement bodies and other competent authorities to ensure the effective identification, investigation and prosecution of cases of trafficking in persons and other forms of forced labour, and to provide statistical data in this regard.
