In order to provide a comprehensive view of the issues relating to the application of ratified Conventions on the medical examination of young persons, the Committee considers it appropriate to examine Conventions Nos 77 and 78 in a single comment.

Article 4(1) of Conventions Nos 77 and 78. Periodic medical re-examinations for fitness for employment until the age of 21 years. The Committee notes the Government’s indication in its report that, beyond 18 years of age, workers are subject to the rules of ordinary law regarding individual health monitoring, and these provide for a medical examination of fitness only every four years for those exposed to particular risks (section R4624-28 of the Labour Code, as amended by Decree No. 2016-1908 of 27 December 2016). In this regard, the Committee recalls that, under Article 4(1) of Conventions Nos 77 and 78, in occupations which involve high health risks, medical examination and periodic re-examinations for fitness for employment shall be required until at least the age of 21 years. The Committee therefore requests the Government to indicate the measures taken or envisaged to ensure that, in practice, young persons between 18 and 21 years of age who are in occupations involving health risks benefit from periodic medical re-examinations for fitness for employment.
