In order to provide a comprehensive view of the issues relating to the application of the ratified Conventions on wages, the Committee considers it appropriate to examine Conventions Nos 26 (minimum wages in industry) and 95 (protection of wages) together.

Minimum wages

Article 3 of Convention No. 26. Minimum wage-fixing machinery. Method of operation and consultations with the social partners. Further to its previous comments, the Committee notes that the Government’s report does not contain any relevant information on the operation of the Higher Council of Wages in practice and the work it has carried out regarding the minimum wage, as well as on any subsequent decisions adopted in this regard. The Committee requests the Government to provide full details on the functioning of the above-mentioned Council, and to indicate the last time the minimum wage or minimum wages have been readjusted in the country. The Committee also requests the Government to provide any relevant piece of legislation in this respect.

Protection of wages

Articles 2, 4 and 6 of Convention No. 95. Scope of application. Partial payment of wages in kind. Freedom of workers to dispose of their wages. Further to its previous comments, the Committee notes that the Government does not provide any relevant information concerning progress made in this regard. The Committee also notes that the Government indicates that the process of reviewing the Labour Law is under way to ensure greater protection of wages, but that it has been greatly affected by the ongoing events in the country. The Committee requests the Government to indicate the measures taken or envisaged, including the reform of the Labour Law or the adoption of any other relevant legislation, to give effect to these Articles of the Convention in law and in practice.
