In order to provide a comprehensive view of the issues relating to the application of ratified Conventions on equality, the Committee considers it appropriate to examine the Conventions Nos 100 (equal remuneration) and 111 (discrimination in employment and occupation) together.

Convention No. 111 – National policy to promote equality of opportunity and treatment in respect of employment and occupation

Articles 1 to 3. National policy onequality of opportunity and treatment in employment and occupation. Persons with disabilities. The Committee notes the information provided by the Government in response to its previous comments on the measures taken in application of Act No. 2017-06 on protection and promotion of the rights of persons with disabilities.
Real or perceived HIV status. The Committee notes the information provided by the Government in response to its previous comments on the measures taken in application of Act No. 2005-31 of 10 April 2006 on the prevention, care and control of HIV/AIDS.

Convention No. 100 – Principle of equal remuneration for men and women for work of equal value

Articles 1 to 4. Gender pay gap. Further to its previous comments on the importance of statistical data on this subject, the Committee notes with regret that the Government has not provided any information in this regard. It therefore requests the Government to take the necessary measures to collect and analyse statistical data on the distribution of men and women in the various economic sectors, occupations and posts, and on their levels of remuneration, in order to identify the gender pay gaps and be able to take the necessary measures to eliminate them.
Article 2. Wage-setting systems. Further to its previous comments, the Committee notes with interest the adoption of Decree No. 2022-692 of 7 December 2022 on the increase in the interoccupational guaranteed minimum wage (SMIG).
Enforcement.The Committee requests the Government to provide information on any measures taken to raise labour inspectors’ awareness and train them in relation to the questions of discrimination and to provide information on any court decision in this regard.
