Article 1(4) of the Convention. Definition of the term “seafarer”. In reply to its previous comment, the Committee notes the Government’s indication that no amendments have yet been made to the Shipping Act, 1998 concerning the definition of “seaman” or the scope of repatriation rights. The Committee further notes that the Government’s indication that the Maritime Administration Department (MARAD) applies a broad interpretation of the term “seaman” to include all persons employed on board, including masters and apprentices, and that, in practice, no one is excluded from repatriation arrangements. It adds that MARAD cooperates with the Ministry of Foreign Affairs to facilitate the issuance of visas and travel documents for foreign crew members requiring repatriation. While noting these explanations, the Committee requests the Government to take the necessary measures to ensure that the national legislation guarantees the right to repatriation to masters and apprentices, in accordance with the Convention.
