The Committee takes note of the information provided by the Government in its report that the new revised Merchant Shipping Code was adopted in 2019 by Law L2019/012/AN of 9 May 2019 on the Maritime Code of Guinea. The Committee draws the Government's attention to the following points.
Articles 2 and 3 of the Convention. Medical certificate. The Committee notes with interest that the new Maritime Code gives effect to the requirements concerning the obligation to issue a medical certificate prior to engagement for employment on board a fishing vessel (Article 2) and the prescription of the nature of the medical examination to be carried out and the particulars to be included in the certificate (Article 3). The Committee takes note of this information, which addresses its previous request.
Article 4(1).Period of validity of the medical certificate. The Committee notes that, according to Article 400 of the new Maritime Code, the medical certificate remains valid for two years, except for seafarers under the age of 18, in which case its validity shall not exceed one year. The Committee takes note of this information.
Article 4(3). Expiry of the certificate during a voyage. Noting that the new Maritime Code does not contain a provision stating that the medical certificate shall remain in force until the end of the voyage when its validity expires in the course of that voyage, the Committee requests the Government to indicate the national provisions establishing this rule.
Article 5. Re-examination by an independent medical referee. The Committee notes with interest that the new Maritime Code gives effect to the requirements concerning the possibility of requesting a re-examination in the event of refusal of the certificate. The Committee takes note of this information.
