Article 4(4) of the Convention. Compulsory postnatal maternity leave. The Committee notes from the information provided in the Government’s report that 15 out of 105 calendar days of maternity leave are compulsory for a mother under section 19(2) of the Parental Protection and Family Benefits Act. The Committee recalls that according to Article 4(4) of the Convention, maternity leave shall include a period of six weeks’ compulsory leave after childbirth, unless otherwise agreed at the national level by the government and the representative organizations of employers and workers. The Committee requests the Government to indicate whether the provisions of the Parental Protection and Family Benefits Act on the minimum 15-day period of compulsory maternity leave have been adopted after consultation and in agreement with workers’ and employers’ representatives. The Committee also requests the Government to clarify whether the 15-day period of compulsory maternity leave is allocated before or after childbirth.
Article 9. Employment protection and non-discrimination. The Committee takes note of the information provided by the Government regarding the cases of discrimination on the grounds of pregnancy, maternity, and parenthood identified by the Office of the Advocate of the Principle of Equality, as well as the measures taken to address the violations. Such cases, in particular, concerned discriminatory practices in regard to performance-related bonuses, performance assessments and accessing employment, contrary to the Employment Relations Act and the Protection against Discrimination Act. The Committee further notes from the website of the Office of the Advocate of the Principle of Equality the issue of an information leaflet “Say no to discrimination of pregnant women and parents in the workplace” due to the frequency of discrimination against pregnant women and parents in the field of employment and work. The Committee requests the Government to continue to provide information on the measures taken to ensure that maternity does not constitute a source of discrimination in employment, including access to employment. In this respect, it requests the Government to provide information on the number and nature of violations detected and penalties imposed. The Committee further requests the Government to provide information on the role and activities of social partners in promoting employment protection and preventing discrimination on the grounds of maternity.
