The Committee notes the Government’s first report.
Article 2 of the Convention. Scope of application. The Committee requests the Government to indicate the manner in which maternity protection is ensured for women workers in the domestic work sector.
Article 3. Health protection. The Committee notes that section 110 of the Labour Code, adopted by Legislative Decree No. 15 of 23 June 1972, prohibits the employer from assigning pregnant women to work which requires physical effort that is not compatible with their condition, based on the presumption that any work requiring considerable physical effort is not compatible with the condition of pregnancy from the fourth month of pregnancy. The Committee requests the Government to indicate the process for the determination that physical effort is considerable in this context, including the measures made available to women who decide not to perform this type of work. The Committee also requests the Government to indicate whether consultations were held with the social partners for the adoption of these and other health protection measures, and the manner in which they cover women who are breastfeeding.
Article 6(2). Level of cash benefits. The Committee requests the Government to indicate the measures adopted to guarantee that maternity cash benefits ensure that the woman can maintain herself and her child in proper conditions of health and with a suitable standard of living.
Article 6(6). Benefits out of social assistance funds. The Committee requests the Government to provide information on the benefits available out of social assistance funds for women who do not meet the conditions required to qualify for cash benefits.
Article 9(2). Non-discrimination in access to employment. The Committee requests the Government to provide information on the measures adopted or envisaged to ensure the prohibition on requiring a test for pregnancy or a certificate of such a test from women when applying for employment.
